We have a short sale with BoA. The Seller lost a job, had to leave town. Should have been an easy short sale, the selling price is very close to what she owes, so what could be a problem?

Put the package together, submitted to the Lender. Does not show anywhere. Do it again, no trace of it on Equator again… and again.

Calling BoA and they say there is something there, and it will not work until the Seller calls them directly.

OK, the Seller calls, and after verifying everything and kicking her from one person to another, they tell her that they can’t talk to her because there is something legal.

So, what to do? Oh, let the attorney call them.

OK, the attorney calls them, and they say they can’t discuss it with the attorney. They said someone would call the Seller within 72 hours.

Nobody called.

The attorney’s office calls CS, they say that there is some flag there, but promise to expedite and remove it.

Time goes by, nothing happens.

Then the Seller gets a letter that she needs to call them and update her financial information.

She calls them, spends 35 minutes being kicked from one person to another… until they tell her that they can’t talk to her, there is some flag on the freaking file, and they are not at liberty to discuss it.

They tell her that someone would call her within 72 hours and explain everything.

Somebody calls her and tells her that they can’t talk to her because there is some flag.

Why can’t they talk to her? Oh, it is because they do not have the authorization.

What authorization? From whom?

- From the Seller.

?????????????????

They need the written authorization from the Seller allowing them to talk ... to the Seller?

 - Exactly….

- You are taking to the Seller, why on earth should I give you an authorization to talk … to me???

Folks, if you think I am kidding, you are wrong. I am dead serious.

Yes, we helped her to fax them the authorization to speak … to her.

I guess this is called CYA.

I assume what represents “A” in CYA is the most important part of their body. Looks like they are using it for thinking.

P.S. The Seller is not an immigrant that can easily be confused. She is a young American sharp and smart lady, who has no problem with English.

Sharon - it is funny you say it. The Seller here was very demanding, and would ask us why something is not done or is not done quickly enough.

Now, after dealing with the Lender herself and making no progress, she is so much easier to deal with

Jon - When an account gets flagged like that, it is an indication of possible fraud. Basically they had more than one person calling in and stating that they were the home owner and the voices were not the same or they verified that it wasn't the homeowner. It could also be that the seller requested all communication to be written and now they need something in writing to reverse it.

Satar - When we contacted them via Twitter and this was the first time they mentioned the legal problem, they said that it was because the homeowner was taking a legal action against the Lender. We grilled the Seller and she said she didn't.

I was thinking about what you said. Maybe that's what happened. What drives everybody crazy is that what they suggest and what you do, never works. they say that her attorney should call and then they will talk to her attorney, and when the attorney calls, they say they can't talk to the attorney.

Nothing of what they suggested really worked.

Then that is it. The seller got an attorney involved, either for a loan mod, or whatever. Maybe even bankruptcy. That attorney had the seller put in writing that all communication be in writitng.

Hi Jon, I just like to add that many immigrants don't have a problem with the English language neither nor are they necessarily easily confused, something that obviously cannot be said of BOA.

Satar - maybe, but then why would they send a letter to the Seller and tell her that she needs to call them at certain number to update her financial information?

And when she calls, they go on their computer and say they can't talk to her, period. Weird...

Silvia - I recently got a comment that my problem could be because of my English. I never though I have an accent in my written English, but I just wanted to note that this was not the case.

OMG, Jon, I'm laughing so hard I can hardly type - the seller had to send in a written authorization to have the bank talk to the seller?  This really does take the cake of all horror stories of short sales.  You would think that 3-4 years after the huge influx of short sales - BofA would "get it."  Guess not.  I'm so sorry you went through this and hope for a positive outcome.

Juli - I would not be ale to make up the story like that. You gotta be beyond crazy to come up with this. For us it is like a dog chasing its tail. You go in circle and it never ends, and then it repeats itself.

I got a good chuckle though... but then I remembered that I am on a mission to brand the foreheads of all the higher ups at BOA with a J on their foreheads... J for JACKASS.
