Some of you may have read my post discussing my nightmare when I moved into my new home.  We had issues with the winterization of the home.  Well, we found out yesterday that when the plumbers were here to winterize, they felt it was too late and there was already damage done.  This was never disclosed to us!  The agent who hired the company to do the winterization never disclosed the company's report to us.  The company's report stated that several pipes were already frozen and they would not guarantee their work. 

Sometimes things are just meant to be.  I believe that if we had turned the water on and discovered the broken pipes, the sale would not have gone thru.  We are so happy here now that I'm thankful for that.
 
The bottom line is this.  The agent needs to acknowledge some wrongdoing here.  I'm not asking for a huge sum of money but I feel an apology is in order.

Call the agent to discuss the report and lack of disclosure.  See if she or he steps up to the plate.  If not, I guess you are already thinking of small claims court???

We did discuss this with the agent, and her response was basically, "oops, sorry".  I hate to take this to court, I'm not a suer.  But, I would like an apology and a little help with the expense.  Is that too much to ask?

I did not read your post of today fully. I guess you have no recourse but to absorb the situation or follow through with small claims. It is terrible to put in such a position. Is there a process for filing claim through the ethices division of your local or state realty board? What about peer pressure? Unfortunately when it comes to the dollar sometimes ethics a few pennys short. The same is true for inspectors and likely every other proffession.

Call your attorney.  My experience has been that a simple call from an attorney can generally get you something in the way of compensation and won't require going to court.
