Today I met with Representatives of the PA DEP / Radon Division.

Conversations evolved into a discussion as to the number of Businesses Advertising the ability to perform Radon Related business activities but do not possess the PA State Certification to perform Radon Testing / Mitigation.

They have been actively reviewing current Radon Service Providors (Testers & Mitigators) in order to bring all Licensed Individuals into regulatory compliance.

There has also been attention paid to those Fraudulently advertising themselves as PA Radon Service providors in both the Tester and Mitigator categories. Civil penalties assessed to date have been quite severe.

As part of your Agreement of Sale contigency related to Radon, it is importatnt to verify the current Licensing of any Tester / Mitigator that you may contract with.

Seems like a simple thing to learn about Radon... but its not... so I understand the licensing for testors/mitigators.  I heard a pretty good interview with an EPA? DEP? person on WCOJ a couple of weeks ago. Thanks for info, Joseph!

At the Federal level, the EPA establishes the guidelines. Not all Sates have Licensing requirements of Businesses engaed in radon related activities.

Pennsylvania has licensing in place with oversight by the PA Department of Environmental Protection (PA DEP).

It is a good practice to periodically review the PA DEP List as Testers have to be certified for the radon methodologies deployed (CRM, Charcoal, E-Perm, etc...) as well.

Complications arise when a Home Seller may challenge a high Radon result (over 4.0 pCi/L) and discovers that the firm used by a Buyer is not certified. The test then becomes invalidated and may jeopardize the AOS Agreement.

The PA DEP has collected over $70,000 to date in fines from Testers / Mitigators performing Radon related business services without a proper License.
