What is Title Insurance and Why It's Important

In Real Estate, a title insurance policy insures or indemnifies owners, holders of liens or encumbrances, or others with a title interest in a real property, against loss or damage to the property title. A title insurance policy is required by a homeowner as it serves to insure the fee or other title interest of the owner. The title insurance policy indemnifies the owner against loss or damage to the owner's fee, or other, interest caused by any of the following areas which may exist at the date of the policy if they have not been specifically accounted for in the title policy:

 

  • recorded liens or encumbrancesTitle Insurance

 

  • defects in the title

 

  • lack of access to and from the land

 

A policy is also generally required by a lender. In addition to the above, a lender's policy insures the identity, due execution, validity, enforceability and priority of an insured mortgage or deed of trust. Title Insurance is an important part of most real estate transactions and it's important to understand what it covers and for buyers to read the Title Policy very carefully.
