We waited patiently for you.  We never wanted to say goodbye. Okay, maybe the wait wasn't entirely patient.  It got tougher and tougher to stay patient as the weeks and months rolled by.

But when we first visited the short sale home, the driveway was covered in ice, and it was uphill.  We crunched through the frozen grass to keep from needing a 911 call.  The insides were still filled with the owner's stuff, and there was no foreclosure sale yet scheduled.

We'd been looking for homes for awhile, even offered on a couple.  But the $80k and less price point for a VA buyer is pretty tight.  Tough to find in decent condition and with enough size to suit our buyers' needs.  But this home, a decent sized fenced back yard backing to greenspace, and enough space inside to let the family grow.


So the offer was written, even knowing short sales could be a bit slow.  The listing agent promised a response within 90 days (and we knew that MIGHT be optimistic).

We didn't put all our eggs in one basket because we knew the short sale might be iffy.  Right at the top end of our buyers' bracket and what if the bank countered back higher than they could go?

And the listing agent provided occasional reassurance...we're progressing, but it's always slow at this stage!  He had everything he needed from us, just wait.

And wait we did, but continuing to look.  Then the seller's Facebook page showed a move to Missouri.  Great, now the house is sitting vacant.  Well at least it's not winter and the pipes aren't at risk of freezing.

Continuing reassurances that the bank is ordering a BPO, we should hear back any week now.  Repeat reassurances the following week...and the following.

We keep looking, but still nothing trumps this house.

Then the stomach drop.  The foreclosure sale is scheduled for July 17th.  Listing agent SWEARS it won't happen.  The bank (CitiMortgage for what it's worth) has our offer and will stop the foreclosure.  We call the foreclosure attorneys and get told they don't do anything about the offer, their job is to execute the foreclosure.

We're still hopeful the bank will come through with a counter at the last minute.


Didn't happen.

Sold at sheriff's auction right on schedule.  We called the sheriff's office and got confirmation.

Listing agent is back to "WAIT, that wasn't supposed to happen!  Let me get in touch with bank!"  He states the bank is reversing the foreclosure and a counter should be coming "any day now!".

Another week goes by, then another.  Requests for updates are ignored, or given with the "haven't heard anything yet, but they're working on it!".

And we keep looking for something better.  And we found something.  Maybe not better (it's smaller both inside and out), but it meets their needs, so the offer is in.

And the short sale?  Talked to the listing agent before submitting the offer on the other home "Yeah.... I don't think this is going to work out."  You think???? (especially since the foreclosure formally recorded September 5th).  This may be the first completely accurate statement we've heard from him.  And maybe things happened beyond his control, we'll never know.  All we do know is words and actions didn't match up.  His name goes into the book of "Agents We Don't Forget".  We REALLY wish it had ended differently.

So 8 months later, we say sayonara to the short sale and hope the newest offer is the one that gets them a home.  By the way, it's NOT a short sale.

And we'll continue to laugh about the word "short" in short sale.

Gary, True statement.  When you bid on one any length of time is possible.  8 months is actually short when I hear some of the worst case scenarios.

Amanda, At one point the seller called us direct and claimed our offer had been sent to the wrong section of the bank, or something lost.  If so, that was never communicated to us by the listing agent.  His inventory list shows plenty of short sale activity and completion, which is part of which makes the failure of anything to happen on this one particularly frustrating.  We're waiting on Freddie M. for a response on our current offer, we'll see how it goes.

It always makes me wonder about these lenders.  Do they have any idea about what they are dong?  Are they so big that one department doesn't know what another department is doing?  Or, is it that the real estate agents that are handling the property get so many properties dumped on them that pretty son they can't keep them straight and pretty soon don't care if they get sold or not?!?!?

 

All in all it makes it difficult for Buyers' Agents to get too excited about helping anyone buy a foreclosure or short sale.  When you look at how much time a Realtor will invest in trying to get the deal to work and figure out how much that Realtor will get paid for the effort, it is a really bad ROI!  I know, you can always look at how happy you made one client and how they will sing your praises, but  . . .

Short sales, as we know, are a frustrating process. The wait with no answer is the hardest part. Hopefully, you're buyer was able to find another option quickly and get it closed.

Jim, It's a mystery.  If the agent specializes in short sales, then they've sought out the niche.  Whether the bank communicates or not, got me!  Was Citi too big to have one side not realize they had a viable offer at the same time another department was foreclosing?  Would make sense, because why else would they not at least try to negotiate the offer before heading to foreclosure?

Sylvie, We've got an offer in now on another house, just waiting on a response.  It was a VERY solid offer so I'd hope it would be accepted.

Joe, So do we.  From a logical standpoint it makes sense for them to exist and it makes sense for there to be a process that actually works.

Your scenario sounds like an agent who took a short sale listing without actually knowing how to do it. Sorry your buyers waited patiently for a heartbreak. Hate when that happens.

Sylvia, And the kicker is I think he DOES know how to do them.  I don't know if the bank was uncooperative, or if he just got sloppy and didn't follow up enough.

Am I dreaming - or didn't the Dodd Frank Act address this problem? I thought the banks were now required to assign ONE person to each house so it would no longer be a matter of the right hand not knowing (or caring) what the left hand was doing.

Marte, Based on the posts I read and the stories I hear, short sale situations are no where near resolved....or maybe the one person assigned to this house was the village idiot (did I type that??). :)

Ahhh the dreaded Short Sale....it's gotten to the point that I care about as much as the bank does about showing a short sale home. Too many horror stories and generally not in clients best interest unless they have unusually speciifc circumstances.

Brian, My feeling too for the most part.  There are times it makes sense, but the buyer better not be in a hurry for a place to live.

Bill and Liz:

You were more patient than I would have been.  Since you hadn't found a home that your clients wanted to make an offer on, staying with the short sale was probably a prudent thing to do.  That is until the foreclosure.  Your clients are fortunate to find a suitable home that is a straight sale.

Evelyn, For the price point, we just weren't finding anything better than the short sale, and trust me, we looked at more than enough houses while waiting :)  Now just waiting on the Freddie Mac response on the new offer to find out if we're on the home stretch or not.

short sales are anything but ... wow .... sadly this happens way too often .... and than we wonder why our buyers do not want a short sale ... go figure

Lehel, We totally understand when buyers tell us they want anything BUT a short sale.  When the certainty of being able to obtain one is better, buyers will stop shying away from them.

8 months seems like an awful long time for no response.  My husband does lots of short sales and we typically can get a home closed within 120 days from putting it on the market.  Of course there are some that are quicker and some that are longer, but not many and usually at least with some response from the bank and reason it takes long.  I hope your buyers got the other one! -Kasey

Kasey, The buyers are happily settled into their new home.  It will always baffle us why we never got a response on the short sale.  They foreclosed, and of course the current list price is LESS than our offer from last year!

Kasey, And ultimately that is all that matters, they got the right home for them and they're happy.  It was a long path to get there, but everything happens as it should.
