What Are Buyer Exclusions in a Long Island NY Listing Agreement?
When buying a Long Island home, sometimes you will see the term: Buyer Exclusions. This means that the seller will take with them certain items that normally stay with the home. The list below will give you an idea of items that generally stay with the home:
- Window treatments - I have seen sellers wanting to take certain window treatments like their children's curtains.
- Light fixtures - A seller could have a family heirloom like a chandelier. They do have to replace it with some other kind of light fixture if the buyer states so and it is not in the contract of sale. Most times it is fine with the buyer since they will want their own light fixtures anyway.
- Applicances - Yes, some will want to keep that shiny new stainless steel refrigerator or washer and dryer.
- Koi Pond - Someone I know had a buyer who bought a home with a Koi pond. The sellers sold it at a garage sale purposely. The seller had to give them a credit off the price of the home because the buyers wanted to keep the Koi pond originally and it was in the contract of sale.
- Sheds - Some will dismantle and take the shed with them. Yes, it happens.
The buyer exclusions are to let the buyer know certain items will not be included in the sale of the home. That is one of the first things I ask a homeowner to ensure what they want to take is taken. If there are no items in the buyer exclusions while under contract and the buyer later finds out the sellers are taking light fixtures, appliances, window treatments, etc., then the price to replace these items will have to be credited to the buyer or the seller has to replace the items. A credit to the price of the home is usually given but the seller can give the buyer a check at closing.
