1031 EXCHANGE BUYERS / TIC INVESTORS

 

Many real estate investors take advantage of the 1031 Exchange, a real estate investment technique that enables a property seller to defer paying capital gains taxes by (a) identifying a "like-kind" exchange property within 45 days after the first property's sale, and then (b) actually buying the exchange property within 180 days.

Under certain circumstances a "like-kind" exchange can include an interest in real estate, where an investor will exchange into a portion of a property together with other owners as "Tenants in Common" (TIC). In such a situation a Tenants in Common Agreement sets forth the rights and responsibilities of all of the property's TIC owners.

This is a complex and technical aspect of real estate ownership that should be guided by an investor's own legal and accounting advisors.
