Can you answer another Realtors question on a listing you use to have?

Today I got a call from a fellow Realtor who I really like and respect. She was showing a listing I used to have a few years  back. This home has been on and off the market with several Realtors. She asked me what i knew about the  property.

I Paused and then stated I am no longer the listing agent and have no authority from the owner to make any statements on his behalf. she then said, i did not think of that, thanks.

 

I have been licensed since 1979 and have not had the question asked. Have you? Do you think my answer was correct?

good question...i think you answered correctly. What gets tricky is when you have two buyers vying for the same property...one buyer gets it, then goes out of contract for some reason, then your other set of buyers wants to know everything that happeded on the first deal which you know about...but what is your obligation? same type of thing...

I also think you answered correctly.  I know agents are trying to get all the information they can for their clients, but we all have to pause and think with each step we take.

I think how you answered was appropriate. I wonder what the agent really wanted to know that she could not get from the current listing agent.  I assume it was listed if she was showing it?

   I have a little different take than the other comments. It certainly will be affected by your state law (I'm an ethics instructor) I would say you can answer questions about what you know about physical attributes of the property but you certainly cannot say anything about the sellers, their motivation or any communications you had with them because that information was gained in a confidential setting.

the agent is a friend of mine and new I would get back with her; she probably did not know the listing agent.

I agree with part of what you said 9can't disclose information about the seller) but I am not certain if I can even discuss what I knew about the property.

Joe, During my 26 years of selling real estate I have not had a question posed to me like that from another agent.
