What is In a Buyer Agency Agreement?

Many people believe that when they are looking for homes and work with a Buyer Agent, that the Agent gets paid for showing them those houses. That is not at all the case.

We can show you one house or we can show you dozens of houses. We can work with you one day before writing an offer for you to purchase a home, or we can work with you for months. We try to look at houses with our Clients and get a feel for exactly what they are looking for, and then we will do extensive MLS investigating, computer searches, and phone calls to agents to try to “narrow the field” so that you are not wasting a lot of time looking at homes that don’t fit your needs.

Once you find a home you like, that is when our work really begins: presenting offers, negotiating, keeping track of deadlines, inspections, appraisals, loan approval, Title commitments . . . just to name a few.

For us to fully negotiate (advocate) on your behalf, we must represent you as a Buyer Agent.  To do so, we must sign a Buyer Agency Agreement.  Some of the points addressed in that Agreement are:

  • The type of property you are looking for
  • The length of time the Agreement will be in effect
  • The duties and responsibilities that we are bound to perform
  • The information we will NOT share with others without your informed consent
  • Our legal relationship with you as a Client
  • How the Agent will be paid in the transaction (almost always FREE to Buyer)
  • Buyers’ acknowledgement that they are not a Client of another Realtor
  • That we will not unlawfully discriminate against any prospective Seller
  • That you may pursue legal or tax counsel
  • That the Contract is governed by the laws of the State of Colorado
  • If it is a concern, that you have a right to contact local law enforcement officials regarding information about possible registered sex offenders in the area
  • Any additional provisions that might be unique to our relationship

I ALWAYS get them to sign the Agency Agreement before signing the Offer Contract. So far, no one has complained.

Yes, Travis, but what if they are getting ready to make an offer on a property and you don't have the BA signed yet. On the way to sign, they stop at an Open House, fall in love, and make an offer? Happened to me two years ago. At the time of making an offer is too late.

So GLAD, Erin. I tell my agents all the time, don't YOU be afraid of it. It's just good business all the way around.

I go back and forth on this but my gut always tells me to get a buyers agreement under certain circumstances and I do. Has not failed me so far. Some good buyers are so skittish, but your gut tells you they will follow through. I play the odds.

We learned the lesson the hard way years ago, and lost a sale because of it. Now, we get a BAA signed on EVERY property, whether its for a period of time or for just a specific property. Better safe than sorry!

I like Buyer's Agreements...unforunately they aren't really used in our town.  Texas has a BRA, but what always scares the buyers is that part of the language states that if the seller refuses to pay the commission, the buyer will be responsible.  This usually stops them right away.  They don't want even the slightest possibility of having to come up with that money.

How many times you work with buyer and suddenly they find something else with a another agent on spot. I use buyer representation agreements and has served me very well so far. The BAA should make sure that you get paid.

Mimi, I totally agree that it isn't right to work for months for free.  I try and get a BRA whenever I am working with a customer, but sometimes they just flat out refuse.  Another issue that has arisen is we have been told that since our Texas form is an agreement and not a contract, we can't sue if the buyer doesn't perform.  

There was an agent in Arlington that sued her buyers because they purchased another home through another agent even though she had a BRA with them.  The judge dismissed her case because he said she did not have a binding contract, only an agreement.  

I would be very happy if we went to a system where agents are required to have a buyers contract like listing contracts.  I know there are other states that require this...it sure would make people really think about who they use and how serious they are about looking for a property.
