Dual Agency is a little confusing to me.
I see it all the time here in Pa and I suppose itQuestion works, but I'm still lost as to how one person can represent the buyer and the seller to the best of their ability. It seems to me as though there would be a conflict of interest some where down the line.

How do you represent the sellers interest in securing the best or highest price they can for their house while at the same time negotiating the best possible deal the buyer can get for his money? I'm just a little bit lost as to how this sort of negotiation can be accomplished by the same person?

I'd love to read your take on this from the Realtors of view. What do you think?

Dual Agency may be rationalized and justified in the minds of some just get a commission, but in name there may be dual agency: however, one can NEVER represent both sides in a transaction.

I think it's a misnomer.  Though I realize different states have different intrepretations of the term "dual agency" you are correct that you can't represent two parties.  I try to avoid it but in the cases where someone wishes to work directly with the listing agent I tell them and have them sign the documents that they are an unrepresented buyer.  I can not do anything other than provide them the comps and fill out the contract as they wish.  My responsibility is to the seller if I am the listing agent end of story.  At least for me.

How can an Agent represent two parties that are Legal Adversaries?  Dual Agency is against the law in Florida; it should be illegal everywhere.

Suesan, Dual agency is allowed in TN but not in our company. We can however default to Transaction Broker and not represent either party just put the deal together. That works well and I have no problem doing that.

I am not a realtor but I understand where you are coming from.  I think it can be done, but it does take a special person to do it.  From my understanding, you must secure the seller's permission and the buyer's permission to even go there.  And, then you cannot disclose much to either party so you are a mediator rather than a negoitiator which removes most of the incentive from either side, one would think!

I don't get it either. Doesn't make any sense to me that one person can represent two different people both looking to get the best deal.

I can't understand it either.  But, I have seen it work.  Whether it works to anyone's best interest is up for debate.
