Eviction Notice, Part 5, Neptune Beach, FL

By
Real Estate Agent with Berkshire Hathaway Home Services Florida Network Realty BK 3030920

Recap: I helped buyers (engaged, he in the process of moving here from out of state) purchase a home in Neptune Beach, FL. We closed 2/15/13, and she gave birth on 3/1/13. On 3/8/13, she was served with eviction notices.

Since my buyer could not be at the attorney's office, I drove her check down there, and was in his office when we did the conference call.  I have to say, while I was sitting there, and seeing the research they had pulled from our Clerk of The Courts, I could not help but feel as though I had missed something.

I had pulled property records to see how long the seller had owned the property, pretty standard for me, as I want to know upfront if the holding time is longer than 90 days (seasoned, as FHA lenders like to see).

As of this post, we have discovered that all the foreclosure & eviction docs were triggered by our closing; apparently a lender from a past transaction claims a deed was forged, and is seeking "quiet title" As of this moment, that is all we know, and we have no idea when the matter will be, or, can be, resolved.

Carol: That's pretty scary for the buyer. The Title search didn't pick that up? How about the Title Insurance?

Carol....I hope they bought owner's title insurance!  Forged deeds are hard for a title searcher to discover.

Oh my gosh! That is too freaky. I am so glad that the title companies are responsible for the title search and not us!! (In Texas!!)

Marc - a surprise, for sure! Hella - no, the search didn't pick it up, not sure how that was missed just yet, or if docs were not filed by that time. Christine - the search didn't see anything, but the ending has yet to play out. Roger - will do for sure! Pamela - it is a one of a kind situation, that is certain. Joni - I don't even think an attorney would have have found this, but will update.
