WARNING ~ YOU BETTER TAKE THAT POST DOWN!

Danger

Today as I was working at my desk I received a very interesting phone call.  The man identified himself as "Mr. Hard Ball, You Better Take that Post Down!"  He was referring to a post that I wrote here on Active Rain over two years ago.  The post he was referring to was a company that was sending bogus leads to agents.  I had received one of those emails and the supposed "lead" berated me for ten minutes as it was the agent himself and the house was NOT actively on the MLS!  So yes, I was upset!

My post however was:

  • THE TRUTH AS IT HAPPENED TO ME
  • FACTUAL

The comments that I received from other AR members also commiserated with my frustration regarding these types of companies.  I have even received a few calls over the years from other agents who read this post telling me they had the exact same experience.

This person then began to threaten me that if I DID NOT REMOVE THIS POST, he would be going online and writing negative things about myself.  Here is the inherent problem with this according to my attorney:

  1. This person has no knowledge of my expertise or services as a real estate agent.
  2. This person would liable for anything written that could defame my character in any way.
  3. This person represents a company that for whatever reason sends agents bogus leads.  This is a problem for those of us in the business.  Don't solicit me for so-called "leads".

So Mr. Hard Ball,  you better slow down there with your threats!  And oh by the way, I write posts here in Active Rain all of the time sharing real experiences in this business.  The truth is the truth!

It is good that you did not take down the post in response to his treat, however it would have been better had you mentioned his name and his company's name.

Having to retain an attorney to prove what you already know to be true is the stressful part.

Paula, I am glad you stood up to Mr. Fuzzy ball. Obviously this person does not understand that threatening (the way he did) is unacceptable in the business world. If he doesn't like what was written about him, he could have answered or written an explanation.

Another GREAT reason not to trust online reviews, etc.  They are so severely subjective and have no basis in fact.

Paula, I would probably have my attorney send such a letter to him. Then let's see how he feels about it.

Paula, i read your previous post. I also get emails from this company. But i think the word "bogus" that you use is the problem. Bogus means false, misleading, counterfeit, deceit. This was more of inadequate quality control on their automatic system. They didn't make up the lead. The comment in the lead proves that. It was actually left by the new owner of the home. Why would you have the person berate you for ten minutes when you called? If you read the comment part of the lead it was pretty clear what happened. The problem is that they don't seem to have a good system for keeping the status of listings up to date. A better word might be "mistake" or "pretty crappy system". But then i see listings on Zillow that say that they are active when in fact they might have sold two months ago. Is Zillow a bogus company? Maybe not very competant about keeping things up to date but i wouldn't say that it is fraud or deceit. Those are pretty serious terms. That company wasn't asking for any money upfront. How did they scam you? Why did you even waste your time calling up the "lead" when you read that comment that was part of the lead that was sent? Also, you refer to the lead as a "he" in this post but as a "she" in the original post. You probably made a simple mistake and probably this post is not a bogus post. Mistakes do happen. You wouldn't want someone to call this a bogus post. If they made fake listings for their site and then sent out fabricated leads in order to get you to pay them for nothing, then that would be bogus. What i read was more of a simple mistake.

those online reviews.......

I have impression that everyone who has no idea how hard you work, can go online and leave a bad review for no reason.

I had a terrible experience last week: I had a call, but I was on another line, when I was done, I called the phone back and he did not answer this time, I left a message and called again later. Someone picked up the phone, said that i must call back again later. I was annoyed. Soon this  person called me very pissed complaining that I did not provide information he was looking for and he is a 'very important investor'. A note: i already had 15 offers on that property in 4 days. I said him that we do have offers. The person became even angrier and promised to report me to a board and where ever  he can and hang up on me. Here we are....I sent him email thanking for his interest in the property and his valuable suggestions.

By "bogus" leads, he means those SOLD or under contract leads that many web sites contain, he might rethink his position.

Me thinks he protests too much.

That's ridiculous that he would come after a post that's two years old, and then threaten you on top of it.  He will get what's coming to him.
