We made another run at closing the house where the seller had health issues that caused the Title Company to prevent him from signing his papers.
Since Friday a week ago the seller and wife have been running around trying to fulfill the requirements the title company attorney was requiring.
The doctor visit was still not forthcoming so the Sellers attorney was looking for solutions. I have still failed to figure how the doctor visit was going to prove that the seller had been in his right mind when he signed the power of attorney several months ago...
What they came up with was for the daughter (and backup executor) to go to the Title Company and state that she was in agreement that they needed to sell the house and that however the wife chose to use the power of attorney was alright with her. Once those papers were signed closing was rescheduled and went off without incident.
It was truly sad to watch as the seller looked on unable to participate . It was clear that he did understand what was being done. I believe that as this horrendous disease is further researched , it will be found that although the victims are unable to communicate , their thought processes are still mostly intact.
My uncle Beto had Azheimer's. We watched as he withered away. First he forgot who his nieces and nephews were. Then he forgot his siblings then his children. Then he forgot how to walk and eat and one day he forgot how to make his heart beat. Yeah Azheimer's is a brutal disease to have.
I've sat at several of those closings and felt so sad for the person, Jeanne & Ralph. More research is so important.

Once was enough for me. It's a sad state of affairs. You handled it like true professionals. If I was in those shoes, I'd want you to handle the transaction.
This is hard to watch as our clients age and finally unable to comprehend the duties needed to be a seller. I hope all works out for you and this seller.
