BOA SENT ME A DECLINE LETTER TODAY AS MY HUSBAND WAS BEING ADMITTED INTO HOSPICE

I made all the trial loan modification payments on time over the phone via my BOA Customer Relationship Manager, yet today I received a FedEx letter stating that my permanent loan modification was DECLINED.  At the same time as the letter arrived, the hospice nurse came to sign my husband up for in-home hospice care.  Can you believe this????

The letter from BOA states "Thank you for contacting us regarding the Home Affordable Modification Program.  While we realize this decision comes at a difficult time in your life, we regret to inform you that we are no longer considering your request for a modification because after being offered a Trial Period Plan, you did not make the required Trial Period Plan payment by the end of the first month of the trial period."

I made the first trial payment on 3/4/13, the second one on 4/2/13, and the third one on 5/2/13.  The original letter from my BOA Customer Relationship Manager outlining the terms for the trial period dated 2/25/13 stated, "To participate in the Trial Period Plan, make your first month's trial period mortgage payment as soon as possible, but in no event later than 30 calendar day after 4/1/2013."

Since I made the first payment on 3/4/13 and it was not due until 4/1/13, it seems to me that I am in compliance.  

This was so upsetting that I could not focus properly on getting my husband admitted into hospice.  My husband is very upset.  He has Stage IV, Pancreatic Cancer and was diagnosed 4 years and 4 months ago.  He's now in the end stages of the illness.  

Can you see where I made an error?  Perhaps I'm not thinking straight due to the stress of putting my husband in hospice today.  It's an emotional day.

Why wouldn't my BOA Customer Relationship Manager call me to tell me ahead of time that this letter was going out?  Why won't she return my calls.  I have had to ask for an Appeal, but this is the last thing I need to focus on right now.  My attention should be 100% on my husband in his final days.  

BOA have a heart!!!!

7 PM UPDATE:  My BOA Customer Relationship Manager called and left a voice message stating that the letter was incorrect.  My trial plan has been completed.  They are reviewing the situation to see which department sent this out and why.  She told me to "have a wonderful day."  Yikes!  I hope that they put in writing that the letter was sent in error.  Thank you all for reblogging, Tweeting, Google Plussing, and FaceBooking this post.  BOA needs to know that my AR friends are watching out for me and won't let up until the permanent loan modification is in place.  Thank you so much!  I love my AR family!

5/20/13 UPDATE:  Two people from BOA called me.  I now have a new "single point of contact".   The first person was from the office of the CEO & President in the Loan Modification Group.  She said that she will get a letter to me by June 1.  I told her that wasn't acceptable.  I want a letter by tomorrow via FedEx stating that the letter they sent me denying me the loan modification last Friday was incorrect.  She said they couldn't do that as they need to research my case!  I then got a phone call from my new "single point of contact" and he said my case had been escalated and what had happened was that I had been approved for a HAMP loan modification, but then that was superceded by a BOA Internal loan modification.  The denial letter was on the HAMP loan mod.  I said if that was the case he should have no problem putting that in writing and sending a letter to me via FedEx for arrival tomorrow morning.  I admit was extremely emotional which is not like me, but my husband only has a few days before he becomes unresponsive according to his hospice nurse.  I took my husband out into the sunshine on our back deck and he burst into tears.  He said it felt so good!  He's been through so much.  By June 1 he will not be here.  Please keep up the pressure to get that letter from BOA into our hands now!  I want my husband to know that I will be able to keep our home before he becomes unresponsive.  Thank you!  We both had nightmares about BOA last night.  Our home means so much to us.  My memories with my husband are here.  Thank you.  I'm rambling.  I'm sorry.  Bless you all!

5/22/13 UPDATE:  BOA sent me a letter stating that they have escalated my case, which we already knew as I mentioned it in my 5/20 update.  I should get a letter tomorrow or Friday from BOA with an admission of their error and a resolution on my loan modification.  Thank you all for your help.  It really made a difference!  My husband is doing well considering that his body is failing.  He is still eating and enjoying visits from friends and family.  We sat out on the back deck in the sun yesterday.  Today it is too cloudy to do so, but I'm going to run out to a French restaurant and get mussels with white wine sauce and pomme frites for him for dinner.  He also wants a glass of red wine.  Still enjoying life!  He's so amazing.

5/23/13 UPDATE:  I was so excited to get the BOA Federal Express letter today, but when I opened it I found another decline letter this one for my appeal.  I'm hoping that the "good" letter offering me a loan modification comes tomorrow.  I was, of course, upset getting this letter, but I assume it is just part of their bureaucratic process from the HAMP loan modification.  I will reserve judgment until tomorrow.  Bill is still feeling pretty good today.  Friends came to visit and other friends came over to help me transfer him from his wheelchair to the recliner.  The aide comes this evening to help me transfer Bill from the recliner to his hospital bed.  Thanks to pain management, he's feeling pretty good and is still alert and able to read, watch TV, and use his iPad to go online. 

5/25/13 UPDATE:  I got the permanent loan modification documents yesterday.  I was surprised to see that the permanent loan modification payments are $200 a month more than the trial payments.  I was told by BOA that the permanent loan modification would not be significantly higher.  

5/29/13 UPDATE:  I signed the permanent loan modification as the $200 difference was due to a recalculation of escrow to include my homeowners insurance which I had been paying and now they will pick up.  My husband is recovering from a bad urinary tract infection.  He's weaker, but still eating, enjoying the company of friends, and we watch movies on TV every evening.  Thank you for all your support during this difficult time.

What the banks are doing to people is horrible.  I am so glad it seems to be on track.  Try and turn it over to God and appreciate the time you have left with your husband.

That they have handled a highly escalated case this way and with all this exposure is unbelievable.

Um, shouldn't a loan modification make the payments LESS, not MORE??? Our loan mod made our payments $200 less, not much but a little better. Good ole BoA, you can always trust them to push the knife in a little deeper...

We hope Bill is feeling better, although with this crappy weather it's hard for anyone to feel too chipper! Keeping you both in our prayers, Gail!

Pat & Wayne, The payments are much lower than my original loan, but higher than the trial payments.  I was surprised.

Gail, I can't help but feel so helpless, I hope Bill is relieved about this, it is not something that should get in the way of his journey right now, or yours.

If there is anything, anything more you need, spell it out and I will do whatever I can. As will we all.

There are no words that my fingers can type, no spoken words that will convey the feeling in my heart for both of you. So I will hold you both there and be thinking about you and Bill. It is a privilege for me that you chose to ask for help, that you shared and continue to share your experience here with me. (I can only speak for myself, but I suspect many of us feel the same).

You are both loved by so many that have never heard your voice in person, nor spent a moment of time in your physical presence but who know you intimately anyway. Bless both you and Bill.

Andrea, Thank you.  Bill and I are doing okay.  We have help four hours a day from an aide and a nurse comes by as needed.  We are sharing this special time together.  There are still good times even at the end.  He sat out on the back deck in the sunshine in his wheelchair today for a few minutes, read the NYT, and is now listening to music.  I am expecting some friends to stop by so I can run to CVS to pick up his medications and got to Stop & Shop to get food.  This time is bittersweet, filled with so much intense love and longing for more, but we accepting that this is what it is.  

Richard, I have a lot of strength.  I'm putting three new listings up over the next week and taking the photos myself.  I've finished the work on two of them and just have one more tomorrow.  I have another agent covering the rest of my sellers and buyers.

Gail -- sorry to hear that the modification payment was higher than the trial period.  Not usually what I heard happened.   Glad to hear that Bill is doing well considering, and that at least you can keep on with your time with him, in familiar surroundings.  My prayers go out for both of you.

Gail: First, many hugs and prayers to you and your husband. I've been out of the loop the last couple of weeks pretty much and just now saw what you have gone through the last couple of weeks. APPALLING is all I can think of saying. No one should have to go through something like this. What about people who don't have the support of the Activerain community? This is just not right!!! Oh, right, banks don't care, they'll make billions while the average person is struggling hard.

Gail - Hospice - I've been there with my husband too. That alone is traumatic, it's like taking the final journey, well, I understand your trail of tears. But boa with no hearts - are something no one needs to go through, especially at a time like this.
