Excuse Me. . .Isn’t This the Job of the Realtor®?

Most builders of single family homes in the Chicago suburbs are heavily impacted by the inability of move-up buyers to sell their current home.  As a result, they are offering a number of creative incentives.   Some builders offer programs that will pay the first six months of mortgage payments, offering a buffer for these buyers to sell before being stretched too thin having to pay two mortgages.

 There are other builders who will buy a client's current residence.  Do they offer market value?  Typically not.  But, again, an attempt to help that "move up buyer" move up faster.

However, over the weekend, I read accounts of a new perk that builders are offering and it concerns me greatly.  Evidently there is an industry that I was unaware of, and it sounds very much like the job of a Realtor® repackaged.

Articles in both the Chicago Tribune and a local paper, The Herald News, indicate that several suburban builders are partnering with companies that offer "real estate counselors" or "moving consultants" who work with the home buyer AND THEIR AGENT to sell the buyer's current home.

Those of you that are listing agents, take a look at some of the services the "counselor" provides. . . .

"Two comparative market analyses"  --- Um, excuse me, as a listing agent, that's my job!  I spend each and every day working in my market.  I KNOW the market.  I KNOW the comparables.  I have probably shown many of them and sold some of them.  I know the intricacies of the local area.  I know the streets where property values shift. I stay abreast of market times and price reductions of homes currently for sale. Isn't this the job of the Realtor®?

"A pricing strategy" --- Again, I am a professional Realtor®, it is my responsibility to know current market conditions and work with my clients to develop a strategy for pricing their home to sell.  Isn't this the job of the Realtor®?

"Staging and preparing the home for sale" --- Many Realtors® provide this service or have partnered with home staging professionals who provide excellent results.  As a professional, I have a team of other professionals at the ready, who provide exemplary service to my clients. Isn't this the job of the Realtor®?

"Marketing the Home" --- How on earth is this the job of anyone but the listing agent?  I prepare and execute a marketing strategy for each home I list.  How a non-agent would better market a home is beyond me. Isn't this the job of the Realtor®?

"Closing the Sale" --- OK, as a Realtor®, I am confused. . .why am I here again?!?!? Statistics for the Utterly Confused Isn't this the job of the Realtor®?

Really, I am not sure how to react or respond.  Where did this niche industry begin and is it gaining a foothold?  Are builders desperate and attracted to any shiny new thing that holds the promise of increased closings?  Or, have Realtors® dropped the ball?  Maybe these companies that offer "consultants" and "counselors" jumped in because the "slap a sign in the yard and pray" method of selling a home is still all too common.

Is this unique to the Chicago area, or are you seeing anything similar in your markets? 

I don't know where this phenomenon started, or at what pace it will grow, but I do know that as a professional Realtor®, I am ready, able and willing to provide all of the above mentioned services and more to my clients. 

Being a Realtor® is my job and my passion. . .Now, if you'll excuse me, I have some homes to sell.

Morning Lori,  Interesting post.  It looks like the builders are trying to offer services to attract buyers and be in control of the transaction as a way of attracting and holding buyers.  I winder what kind of training these counselors have ( former Realtors perhaps ? )

I haven't heard of this either & hope we never do!  Down here, the builders are "cooperating with brokers" big time...offering some very sweet commissions.

Seems to me that this would be against licensing laws because the services all equate to practising real estate..Wonder if the builders are getting them licensed.

Lori - I've noticed that when the market is hot the builders cut out cooperating with Realtors, but now they are inviting us to lunch to sell their inventory.  I've not heard of anything like this in my area.

You are right that those are services that should be provided by the listing agent.   I think this development is in response to the "3 P" marketing that so many in the business utilize: Put up a sign, Put it in the MLS, Pray.  I got back into the business a little over a year ago precisely because I saw the market shift as an opportunity.  Most folks in the business don't remember the interest rates of 1984 and the change that the '86 tax changes made.  They only know the anomaly that was the market from '98 to '05.  Now they are deer in the headlights.

Bill -- I think you are right, control is the goal.  I have no idea what the background of the "counselors" is. . .could be that you are right and they are former realtors who want a steady paycheck.

Dalia -- We have builders that are offering some great commissions, too. . .The little "phenomenon" that I wrote about caught my attention in the papers.  I hope it doesn't spread.

Courtney -- Valid point.  From the articles, it seemed to me that they were outside companies that builders were partnering with. . .I need to do more investigating.

REALTORS aren't licensed by the State, real estate agents are. If in these ads they are practicing what is required in your state to have a real estate license turn them in.  Many builder are also licensed real estate agents and brokers, and many builder companies have a resale division.  You cannot move up if you cannot sell a home.  There are so many new and part time agents that have no idea what they are doing as far as pricing and marketing.  That is a major part of the problem!  As long as tehy are not soliciting a listing it sound legal to me.

Steve -- "3 P"  LOVE IT!  You are right.  I have been licensed just two years and am working my tail off. . .I consider myself fortunate that the first couple years weren't easy.  I know how to work and will end up running circles around other agents who have been spoiled by the "boom"

Jim -- You are right, Realtor vs. real estate agent. . .This blog was based on a couple of articles from the real estate section of our papers.  There was no indication that these "counselors" were soliciting listings, but rather providing services to the client in conjunction with the real estate agent. Could be legal, but in my view it should be unneccessary.  The listing agent should be providing said services. 

You are right, again. . .the industry has been glutted by new and part time agents. . .huge problem!

Builders want one thing - control! They want to take control away from the Realtor and pull all strings in the transaction. They want to control all areas of the deal for the buyer so they can close on that new construction.  They don't care who's toes they step on offering "consulting" to the buyers, in turn to sellers. Lori, you are in my market area and I would be interested in knowing who these builders are. They often come to our office selling their "wares" and I would love to personally confront them in front of an office of fellow "counselors".

Listening to your Needs
If it works you will see it more often. We see little new construction in this market. On the same point much fewer people are moving up, instead they are staying put enjoying the lower costs of living in their present home. This was a major part of our market.

You are absolutely right, these clearly are their listing agent's responsibility.  Do you think they are trying to squeeze out the Realtor?  FYI, I have not seen this in our area at all.
