Realtor and Loan Officer?????

    Is it ethical to be a Loan officer and a Real Estate agent? I am sure there are lots of opinions out there on this subject.

 The reason this is coming up now is that I just got burned by a loan officer. I have a client that speaks very little English, so I called a few mortgage brokers and asked for a Spanish speaking loan officer. This particular loan officer was recommended by another loan officer. I called her and told her about my clients and their situation. She said no problem, she would take care of it.

To make a long story short, they went to her office and she wrote up a contract on the property that they were interested in and had them sign a buyers agreement.

I am really ticked off. Her broker says he will talk to her, i haven't heard back from anyone yet so I am not sure what is going to happen.

UPDATE: The loan officer in question is no longer handling my client as a loan officer or an agent. I am so glad her broker took my side in this.

I am both.  I got tired of real estate agents stealing my mortgage clients and giving them to their mortgage person.

I've thought about that long and hard and while there is a LEGAL answer to that (yes, you can do both), for me personally, it is a NO.

I can not, in my own conscience say that I am representing my buyer as their agent and NOT doing so as their mortgage person.  A RE agents fiduciary duty is very specific and legally outlined.  A mortgage person has no such fiduciary responsibility to the buyer. 

How very sad that this person did this to you.  MY suggestion would be to make sure you have some loan people you trust that speak spanish and maybe some other languages BEFORE you actually need them. I can't see any other way to protect yourself.

Intesting story.... For this reason, I'm very hesitant to do business with some LO's who even have a family member who is a Realtor. Althought you would hope something like this won't happen.... It is possible.

Don't blame you for being ticked off.  It might be a good idea if you give her name and organization our so others won't be ripped off by her unethical ways.

  It's ethical as long as it's disclosed. Texas allows dual capacity. The greater breach of ethics sounds like it's between you and the other ahem.. Professional ?.

I'm a little confused however, you sent your client to someone for financing for a property that they were interested in without representing them as buyers agent ?

I'm a team guy. I like the idea of professionals that are the best in their industry working together. So, while theoretically it's possible for someone to stay up to date on the best of buying and selling real estate and the world of home loans, I think it's rare at best. There are some reputable folks here on AR that do both and I hope they comment.

Could I list or represent buyers? Yes. Would that be best for the buyer or seller? I don't think so.

Gary - That's for sure

Russ - I have never stolen a client. If they come to me with a loan officer that they like and he can get their loan, that is great, less problems in the long run. I do advise them to shop around for the loan that is best for them.

Ron - I have found a couple now!!

Roland- This is the first and probably last time I work with a loan officer that is also an agent.

Bob -  I work with a team of 7, they will not use her.

Darren- I was representing them as a buyers agent, and she knew it. No i did not get them to sign a buyers represtation form, kinda hard to explain that in my broken Spanish. 

Joey - I am not sure about that either.
