What We've Got Here is a Failure to CommunicateYou get extra points (not really) if you remember that line was spoken to Paul Newman by the prison warden in the 1967 movie, Cool Hand Luke. It's one of the most famous lines in all moviedom, actually number eleven on the AFI list. And who doesn't love movies?

On occasion, that famous line can be readily applied to our business. 

We've been trying to work a deal for the past couple of days on one of our listings. The offer came in to us without a pre-approval letter. We sent two e-mails and a text to the agent asking for the letter. Guess what? No response. 

We called and the agent informed us that he would have it to us soon and then asked if we were accepting the offer. We said no we needed the pre-approval letter. No response again.

After waiting and never receiving, we countered their offer. We texted and e-mailed the agent that a counter had been sent. No response. We sent another text asking if he had received it. This time the response was "OK". We had to laugh because we weren't sure what that meant.

It would really be great if we all responded in a clear and concise manner or we'll be saying,

What We've Got Here is a Failure to Communicate.

That's very strange. In this market, the buyer's agent is usually very eager and responsive. Good luck working with that agent if your clients accept the offer...

Unfortunately, this scenario happens a lot. Borrowers convince agents to take them out Because they think they can qualify.

I can totally agree with this Tom. I have seen qute a lot people having trouble because of oe thing. Failure to communicate. or at the least, Communicate well.

It is so hard to understand why people just can't pick up the phone or send an email.  It's so simple and there, it's done!  I have a buyer that won't return calls or emails to his lender.  What is up with that!  I guess, people just think they are too busy!

Wow! That's rough. My theory is that some agents (or people in general for that matter) think they are saving time by not handling their communications properly (don't answer or give incomplete answers) when in reality they end up making more work for themselves and the person at the other end of the communication.

No my friend thats not a failure to communicate thats a failure to be honest or function properly!?!?!?!

It takes 15 minutes to review credit and income to ensure those pieces of the puzzle fit not days on end. Somethings wrong with that buyers file

Well Tom, the Captain (Strother Martin) would probably agree with you.  Lets hope that the buyer, unlike Luke, will survive the purchase process.  He is probably very busy right now cutting the heads off of parking meters to come up with the down payment!

You can't control the actions of other people.  You can control your own.  What if you had responded to his offer asking for a $10,000 deposit and no financial contingency?  That would put the ball in his and his clients court.  They could accept your counteroffer or go away.  If they don't have the financial ability to close, they would forfeit their deposit.

Love it. I can't stop laughing. For the past several years when we were working with REO agents we actually felt blessed if we got anything more than a two word answer after a weeks wait. It works both ways. On the REO listings we had the buyer's agents were super appreciative that we called them whether they got accepted or not.

Don't you often feel as if you are working both sides of a deal and the other agent is "missing in action."  I could not get a response on a request to see a listing for three days.  Finally called the broker and he told me the agent was out of the country.  That explains "mailbox is full" but I think that texts and emails still work!

I like this post.  Recently had an agent who did produce a letter from the lender for the buyer however when the seller accepted the offer I was asked to hold the earnest check until Friday before submitting!  As we all know we must submit checks immediately.

Tom, can you imagine if his buyer was aware of what was going on?  Lets hope they were not otherwise I would think your phone would be ringing from the buyers directly.  I am amazed every time I read stories like this that somehow agents make a living selling real estate in a very different way than most of us do.  Yikes.

I don’t agree that there is a failure to communicate. The communication is pretty clear. What is being communicated is that you are dealing with an agent who is unprofessional – perhaps inexperienced – and not capable – or unwilling – to provide what is needed in order for your client to properly consider the offer. That offer is going nowhere.

What We've Got Here is a Failure to Communicate.  I think we could have preprinted memo sheets to that effect in this business sometimes and of course at other times we are all the best communicators, after all that is our really what our business is, communicating the wants and desires and needs of our Buyers and Sellers.
