As someone who left corporate life because of ethical issues, I found it refreshing to find that the NAR had a code of ethics. Unfortunately even in this industry there are still a lot of people who do not understand what this means. One of the items in particular is Standard of Practice 1-9 and the obligation of REALTORS® to preserve confidential information.

One of my favorite people to quote is Abraham Lincoln, who once said, “Better to remain silent and be thought a fool than to speak and to remove all doubt.”  More agents should take this to heart. Working in an office with another 140 agents, you just never know who is going to bring you and your client your next potential buyer. Why on earth would you ever discuss your client’s personal information to any other agent. 

Cause
I have personally heard agents talk about how anxious their clients are to move out of their homes they would accept a much lower offer. If your clients had said go ahead and let people know that you will take an offer maybe talking about it like that is OK. However, wouldn’t you provide a better strategy than just talking about it casually? More likely the clients did not want this information getting out.

Result
How much of an advantage would I have now when I bring in my buyers and they want to make an offer on that house? I did nothing wrong. I have a buyer’s agreement already in place. This information was distributed because an agent decided to talk about a client’s information in public. This is just unacceptable behavior. It goes against our code of ethics and it could easily cost the seller’s a lot of lost money. The client is starting off at a huge disadvantage because their agent made a public statement about the client’s motivation.

Solution
Next time you are having coffee, lunch or a public conversation, especially in your office and before you open your mouth to remove all doubt, remember it is better to remain silent. We all like to talk about our day and sometimes even our clients. Personal and confidential information has no business being discussed outside of your clients any time before, during or after the sale. Confidentiality does not end when your relationship with the client does.

I've heard this in my own offices and read stories.  I'll never understand why any agent would reveal client weakness to anyone, let alone another agent.

Jeff, I couldn't agree with you more about this posting. This post reminds me of a post I read on here the other day on here about discussing someone's negoating position at a coffee shop. The poster summed it up by saying that one never knows whom is overhearing the conversation. For all they knew, the listing agent from the transaction may be at the same coffee shop and listening in on their strategy. 

The amount of personal and confidential information that Realtors need to access in order to due business is frightening. Between tax returns, social security numbers, pay stubs, I think that data security needs to be the highest possible. Enforcing HIPAA standards would go a long way to ensure professionalism in this industry.

I have read each of these comments and want to thank you for sharing your thoughts and stories, While I agree nobody is perfect but the amount of times I hear this goes beyond a slip now and then. The biggest problem is if we do not start changing that means all the new real estate agents may think it is all right too. 

When a potential client, whom you've never met', hears this from you and then you are in front of them, do you think they are going to sign the listing agreement with you? You just never know where that next client is going to come from or how many other people they might tell about what they heard.

I'm amazed at the agents that share information they shouldn't, you are right, always better to keep information to yourself unless your seller authorizes it in writing and that should constitute a price reduction, and then it should be in the MLS to move it quickly!  Other areas abound like fair housing law violations that I'm sure are more prevalent than they should be.  So many areas that agents need to be careful as fiduciaries!

At one time, I used to speak without thinking, now I think before I speak.  That is one of my favorite quotes, "It is better to be quiet and be thought a fool, than to speak and remove all doubt."  The reason is, it is so true.  When it comes to a client, it is best to keep quiet about what is going on with your clients.
