Do I have to tell a Buyer if i know something is wrong with my house?

By

What do you have to disclose and what can you hide? Asked a Home Owner looking to List their Home. I was interviewing with the owner when they asked me this. The correct answer is a seller has to disclose everything they know. They did not like my answer and told me another agent from a BIG company told they did not have to say anything. lI let them know that whether selling a home in the MANCHESTER NH AREA,. or anywhere, the correct thing to do is to disclose everything on the Seller property Information report.

They told me their furnace always shuts off and there seems to be a lack of heat. I walked through the home with them and when we got to the basement took a look at their furnace, it is less than 10 years old but had no service tags. They asked what that was. I told them you get one when you have your furnace cleaned. They said they have never had their oil furnace cleaned. I let them know they should do it every year.

i also noticed they finished their basement and closed in the furnace in a small closet like space, there is no fresh air getting to it to assist it in functioning. between these 2 items i may have found their problem in an instant. They told me to mind my own business. i told them Good luck in selling their home, but i ONLY do things right and can not take instructions against the law, ethics and how I do business. When they are ready to do things the right way, i am here to help them.

Home Sellers do not always want to hear the truth, but not only will the truth set you free, it will help you sell you home. if the only reason they are selling is because their furnace is not working, for less than a couple hundred bucks their furnace could be cleaned and a make up air tube put in.

Having a GOOD Listing agent can over come most problems through communication and the expertise to guide the home Seller through each step of the home Selling process.

The BEST way to be prepared is by hiring a "GOOD" Agent. One that will guide you through each step of the Buying or Selling process. To the consumers who were successful, they found the secret which I would like to share with you.

THE TOP TIPS TO FIND A "GREAT" REAL ESTATE AGENT

 1. LEARN THIS ONE FACT: One should know that All Agents are not created equal and every buyer or seller should take the time to hire the BEST not just the biggest Agent or Company. It is important to Hire the BEST Agent. In NH that could be me.

2. CHOOSE THE RIGHT AGENT: As a Buyer OR Seller in this market you need every advantage you can to get your home sold. It starts with choosing the right agent. a. Ask for a Full time agent whose sole job is to sell homes. b. Ask for a Full service agent who will guide you through each step of the selling process. Discount brokers often equal discount services. c. Ask for a Local agent who knows your neighborhood and is readily available when you need them is a must. Out of town agents can leave you high and dry in your time of need. d. Ask for a well experienced Listing Agent can give you the advantages you need when selling your home. Not all agents are created equal. Choose only the best.

 3. HOME BUYERS SHOULD START BY:  Getting a FREE PRE-QUALIFICATION with a local and trusted lender. They will look at your credit and financial picture and let you know what type of mortgage you may qualify for and what your interest rate and monthly payment may be.

4. HOME SELLERS SHOULD START BYGetting a FREE MARKET ANALYSIS. Learn what your property is worth in today's market along with how ling it may take to sell. If you are ready to sell now, learn what you should ask for it. How much offers may come in at and what the approximate selling price should be. NH Home owners should contact me now.

IN SUMMARY the key to having a successful purchase or sale can increase simply choosing a better agent. The secret is that All Agents are not created equal and every buyer or seller should take the time to hire the BEST not just the biggest. I leave you with now infamous philosophy, which is simple, to provide more personal and professional service to guide my clients through each step of the buying or selling process.

It does not take magic to turn your "For Sale" sign into a "Sold" sign. it takes a full time Local Agent who specializes in Listing homes like yours.

If you are thinking of buying a Home please contact us. Get a free pre-qualification along with some of the BEST CUSTOMER SERVICE through each step of the Buying Prices.

Scott in Virginia we have a property disclaimer and it is buyer beware.  Home inspections are an absolutely MUST here.

Scott, so many sellers learn the hard way that "Don't ask, don't tell" is not applicable to a house that's for sale.  This is probably the number one cause of lawsuits around here.

Disclose, Disclose, Disclose. They can hide it, but a good inspector (heck even a bad inspector) will find that problem.

Bet they didn't get permits for the finishing out of the basement.

Hi Scott - There's no substitute for honesty from all parties to a real estate transaction - and that concept should also be extended to life in general. Lying and deception never lead to anything good, and you certainly took the right stand. Kudos!

Whether selling a home or finding a sack full of money, the principle is the same: "Honesty is the Best Policy" and that makes it the ONLY POLICY to live by.  Lawyers make a lot of money off of people who think they are smarter than the average bear.  As Yogi would say, "Right Boo Boo?"

In California we take disclosures very seriously. Always disclose. Those homeowners should have thanked you profusely--you might have diagnosed the problem with their heater which could be remedied easily.

I saw Johns' reblog but wanted to come over and let you know this is very timely for me.  I knew that. But having listed three of my rental homes and got a fireplace inspection which says $1500 work is needed. Well that is easy to decide, it must be done.
