What Does A Tenant Have To Maintain In A Rental Property in Florida?

http://www.woltersrealtyandpropertymanagement.com/HomeI recently wrote a post about the obligations of a landlord in Florida.  you can see that post here:  According to the Florida Landlord and Tenant Law, the landlord is not the only one who has a legal responsibility to maintain a rental property.  The tenant also has certain legal obligations to maintain a rental property:   

(1) They must comply with all local and state building, housing, and health codes.

(2)They need to keep the premises clean and sanitary.

(3)All garbage must be removed in a clean and sanitary manner.

(4) All plumbing fixtures must be kept clean and sanitary and in repair.

(5) They must operate in a reasonable manner all electrical, plumbing, sanitary, heating, ventilating, air conditioning and other facilities and appliances, including elevators.

(6) They may not destroy, deface, damage, impair, or remove any part of the premises or property therein belonging to the landlord nor permit any other person to do so.

(7) They must conduct themselves and require other persons on the premises with his or her consent to conduct themselves, in a manner that does not unreasonably disturb the tenant's neighbors or constitute a breach of the peace.

The lease can require more obligations on the tenant, but in a case where there is no lease, or a not very good lease, the tenant would at least have to comply with the requirements of the law.

Those are pretty simple rules Cathy. I just wish all tenants followed those rules and took care of the properties they rent.

That seems comprehensive. If I'm not mistaken, it is much easier to evict a tenant in Florida also.

In Texas, the landlord spells out what the tenant is responsible for, in addition to the terms listed in our promulgated contracts, prior to signing a lease with a tenant. The list varies from landlord to landlord.

Ok I have one on this, who do you all think is responsible for bed bugs? They are a donor bug meaning a body carries them in to the dwelling. I have a rental property where the tenant brought in the bugs, HOA says although several other condos owners/tenants have them it's not a building issue which I totally agree with. So does the tenant pay for abatement or Landlord. My broker was a little grey on this one, love to hear your thoughts. Hope it's not off task of the blog.

Great list of what is expected of tenants in Florida.  I'd say that's pretty universal but I'm sure others on AR have more thoughts and comments from their areas.  Complying with HOA rules is pretty high on the list here.

Unfortunately "must do" and "do do" are not always the same thing. Some tenants simply don't follow the rules.

I've always found that the laws set the minimums, the lease sets the expectations and the way the landlord or property manager handles the property has a big impact on how the tenants will respond.

Cathy, this is great information, and it reminds me that I need to check our state statutes to see what is required of a tenant here in Arizona. I have never been a landlord, and have never really dealt with that side of the business, but it would be good to know.

Jan, yeah this is just a basic bare bones minimum. 

Marte, you are right unfortunately about some tenants. 

Joe, yeah the lease is key and you need to be proactive. 

Troy, yes always good to know the laws for your state. You may have an investor that might ask. 

Anna, yeah it does seem like simple common sense.
