#33 - What would you do?

Your buyer is ready to close escrow on a short sale and the out of area listing agent calls you and says the buyer is taking the stove and the blinds even though the contract says they are to stay with the home.

What would you do?

1. Send over a copy of the contract to the listing agent and broker with a note that the buyer will pursue small claims against the broker, seller, and bank.

2. Go to the house and see if the items are still there and talk to the seller in person showing him the contract.

3. Just wait and see what happens. If the items are taken, offer the buyer some money to cover part of the cost of a new stove and blinds.

4. If they are taken, just buy new a new stove and blinds for the buyer.

I would start with #1 - I would email the agent & his broker contract lines showing that it was contracturally obligated to stay.Ā  My guess is that would eliminate the need for anything else!
