Is your contract VOID to begin with?

So many times in this business, I see contracts that do not have an adequate legal description or no legal description at all. Did you know that makes for a VOID contract in the state of GA? Even if it says "Legal Description to be provided" or similar language, it is still VOID. Granted, I have seen VOID contracts close, but why take that risk??? The legal description must be attached/provided at the time of the contract. Ask sellers to provide a copy of their deed, check to see if it is listed on the GSCCCA site (www.gsccca.org), go to the court house & get a copy or have the closing attorney send it to you..... just make sure you have it and that it IS part of the contract to begin with!

Nothing is a problem until there is a problem. Don't take the risk!

Karyn-Agreed, the legal description is a required element for legal contracts in Texas too.
