Seller Financing: How Safe Are You From A Non-licensed Predator?
Seller financing, when orchestrated by a Licensed Real Estate Broker who is highly experienced in this type of transaction, is an incredibly effective tool in today's marketplace. It allows sellers to control their property, credit and financing decisions while moving a home faster and typically with a sizable return on investment.
It is important for sellers to realize that there are more unlicensed, and often unethical, people out there who claim they will buy your house - even your ugly house, who have no clue how to properly put a seller financing deal together. They typically like to call themselves "investors." They are investors with no cash of their own, equity or right to your property - unless you give it to them. They then leverage your property for a quick buck.
A non-licensed middle man (or woman) will collect hefty fees by taking control of your property in one manner or another. These people accept zero responsibility for the failure of the transaction when it happens, and it almost always does. The contract you sign with them as a seller gives them every out and is always written in their favor - not yours or the buyer's. The buyer will have to sign a similar contract and most often a "liability release form" is slipped in at closing in their attorney's office.
Over the years I have come to really appreciate the flexibility of Owner Financing terms... when professionally designed with integrity to all parties. I view our Seller Financing Program as being akin to a match making service. We pair up the perfect buyers and sellers, go through the 100+ checks and balances to ensure we have left no detail to chance and close the deal with a champagne toast to new beginnings for both sides.
Properly designed Seller Financing is a lot of hard work and does not fit inside most real estate professionals' wheelhouse. I think that is why so many non-licensed "investors" have flooded our marketplace with these bogus deals that end up in court, though many don't even get there because of the high cost of litigation. Buyers can lose thousands to hundreds of thousands of dollars and sellers risk serious and costly damages when a contract is poorly executed. Signing in 'their' attorney's office gives YOU no protection, either. Make no mistake, this type of transaction should never be left in the hands of someone who bought a course for $999.00 off a late night infomercial and is trying to get rich quick while preying on people that simply do not understand the risks.
"There are viable methods and processes to Seller Financing." We have those methods and processes in place because we possess the experience, education and credentials that put us at the top of our game in order to properly facilitate these transactions and truly help people.
