Another good question just reached me via telephone from a Blog Reader.
A party interested in purchasing a condo in Massachusetts wanted to know ...
What is a 6D Certificate?
Who Provides the 6D Certificate?
Why is it so important to the Buyer?
Who's typically responsible for obtaining the 6D Certificate, is that another item on the Buyer's to do list?

I included a sample of a 6D Certificate in Massachusetts Below. Typically a Seller of a condo in Massachusetts is responsible to obtain the 6D Certificate from their condo association (of course everything in a transaction can be negotiated).  The Seller notifies the condo association they are selling and the condo association checks to make sure all condo fees, condo liens or any fines have been paid in full.  This is a document prepared in accordance
with Massachusetts General Laws Chapter 183A, Section (6d)  .  I have not been involved in a condo sale where we could close or should a Buyer want to close without the Seller providing a 6D certificate to the Buyer showing all fees, etc are up to date.  A condo Buyer will be responsible for any debt on their condo - whether they incurred it or the owners before them and disputing it may be no easy task.
sample below of document you should receive prior to the closing, make sure dates are current, if a closing takes place on the first or after during that month, condo fees are typically paid for that month by the Seller and a per day credit to the Buyer is given on the HUD sheet.

Thank you Steffy - and so many do not even read through their master deed and bylaws and then wonder why they are unhappy after the purchase, cannot stress enough that all condo docs are not equally written.  Have a grand say Steffy.
