A Sinking Feeling

I received a referral from a Realtor referral partner a few days ago.  Joe Petrowsky and I met with the lady yesterday.  I had a feeling from my first phone conversation with her that this was going to be a difficult, if not impossible, situation.  Unfortunately, my initial feeling was correct.

The lady is going through a divorce and her soon-to-be ex-husband is not cooperative in the least. To make matters worse, the Realtor who referred the matter did a BPO on the property and it is upside down.

The property is the lady's primary residence and consists of about 5 acres.  She runs a bird sanctuary and animal shelter on the property.  She is determined to keep the property and buy out her soon-to-be ex-husband one way or another.  Unfortunately without the husband's cooperation we could not figure out a way to refinance the property, allow the lady to keep her bird sanctuary and animal shelter, and pay-off the husband.  We just could not come up with a workable solution and I personally feel absolutely terrible that we could not help this lady.  She is just so determined to keep this property and her animal shelter and sanctuary.

I received a call from her this morning and she sounded quite excited.  She found some people who are willing to make a donation to her non-profit corporation that actually runs the sanctuary and shelter.  I didn't want to tell her that the funds needed to be a gift to her from a family member, but I did.  She was going to call her accountant and the people and see if they can come up with some way to make this work.  Just such determination and all I can do is tell her that it doesn't work unless certain rules are followed.  She promised that she would be getting back to me.  I am hoping, but I still have a sinking feeling that it is just to much of a stretch.

Randy, check with underwriting, but a non-profit is an acceptable donor.  So the non-profit can make a gift to her if it does not violate the terms the non-profit operates under.

I was not aware of that George, but she is checking with her accountant to see if there is some way to get the funds to her in the form of wages, costs, expenses, etc., as I do not believe the non-profit is paying rent.  Obviously it is tricky to get funds out of a non-profit.
