What You Need to Know About Copyright on AR

Copyright is everywhere. Anyone who tells you that something is copyright-free is not doing you any favors and could get you into trouble. They are very likely mixing up the legal term, "copyright" with "royalty-free," "trademarks," and/or  "creative commons licensing" terms.

Someone out there has to create content in order for it to be available. The term, copyright, is defined by the US Government as follows:


A form of protection provided by the laws of the United States for "original works of authorship", including literary, dramatic, musical, architectural, cartographic, choreographic, pantomimic, pictorial, graphic, sculptural, and audiovisual creations. "Copyright" literally means the right to copy but has come to mean that body of exclusive rights granted by law to copyright owners for protection of their work. Copyright protection does not extend to any idea, procedure, process, system, title, principle, or discovery. Similarly, names, titles, short phrases, slogans, familiar symbols, mere variations of typographic ornamentation, lettering, coloring, and listings of contents or ingredients are not subject to copyright

As a staff member here on AR, I get the occasional email from a member notifying us of another member committing a big no-no on the site - copying and pasting someone else's work onto their blog and publishing it as their own. Here's our official board of no-nos, if you need to recap. While the biggest no-no is copying and pasting, we often come across the occasional image issue. 


It's so easy to share images on our site, but just because you can, it doesn't mean that you should (at least without permission of the original creator). Why? The original creator can find that image through a handy little Google search and tell you take off that image - if they are nice. Big media moguls such as Getty Images are notorious for their crusades against unauthorized use, demanding high-priced licensing fees, on the other hand. See here for more info. Keep in mind that some people and groups only give permission for individual use, but not for commercial use. You need to know the difference.

 

 It's not worth it to be sued. If you're not sure, don't post it. It's better to be safe than sorry. You can also reach out to any legal aid in your area regarding copyright if you have questions. We also have some very savvy attorneys on our site!

 

I came across a really great blog post earlier today referencing sources of FREE COMMERCIAL USE images. It's definitely worth a look - be sure to read all disclaimers first since they all have different terms though:

Start off your year purging out any old pictures and content that you didn't create or have permission to use. This will also give you a chance to update any old content and purge all that dead SEO weight.

Mary - Always good to see a post like this. I am a stickler for copywright infringements. I have had so many pics taken and then taken down because I went after them. Not like Lenn but in my own way. The cut and paste seems obvious, but then again. I do not allow reblogs of my AR posts and I do not reblog because of double trouble. I'd rather not deal with someone else's copyright infringement.  There's nothing I can do if they link to my post, however. I've heard blogges say that if it's on google images they can use it. Hmm, I'd be very careful about that -- just because it's on google, doesn't mean it's free to use.

Copyright infringment is a serious crime.  Married to the Artist that I am, I can understand why this lawsuits are filed.  Larry spends hundred's of hours researching, sketching, painting and fine tuning his artwork and would not hesitate to file suit against someone who decided it was okay to reproduce it without permission.  Don't take the chance!

Kevin Mackessy Yep, it does. What's really interesting is that images can rank with their own SEO based on tags and shares (this is pretty much how Google Images works). Google Images has some great images, but they aren't up for grabs. If you find an image that you like and would like to use, it never hurts to contact the photographer/creator to ask permission. The worst they can say is no, but I'm sure they'd appreciate you asking first.

Suzanne McLaughlin If you have old posts, I'm not going to be too harsh - I too have images that need to be updated on an old Blogger account that has since been abandoned. It's a work in progress, so I know how you feel. I don't want you to feel pressured to spend all day doing that though. I know your time is valuable. I would say that if worked on it over time, that would be reasonable enough.

Mary Weiss just don't know why some people think that if you see any picture on Google, you can use it anywhere. Read a post from Lenn Harley with all the links to copyright issues and here is one more -

it's serious and one should understand it. It's not worth being sued for this.

Evelyn Johnston I completely agree! We invest so much of our time and passion into our work and it's so aggravating when people don't give a second thought to that. I watermark all of my own personal images that I care about to hopefully stave off someone from anauthorized use... or to at least have some credits back to myself. Unfortunately, not everything can be watermarked though.
