Drastic times require some hard core writing in today's blog. When a new Bank Owned listing hits the market, it is a given my marketing will attract a HUGE response filled with showings and multiple first day offers. Buyers and their Buyer Agents will jockey for the best offer. Some will opt to play games and offer some crazy low ball bids that knock them right out of the mix. A very small segment may opt for trickery. So when one agent ordered, stomped and even screamed that " I " needed to get up on the snowy roof to take a picture proving it did not leak, i should have known they would be trouble.

 

Some of the trickery includes writing an offer as cash and then switching to a private mortgage is one common scam. Banks are aware and have a disclosure for cash offers that cash purchases can not be switched to financed purchases. The instructions are simple, no changes can be made, initial every page and sign and date where needed. What do "some" agents do? They make changes, but no changes are allowed - result is to start over.... Dont sign the page they want changed, result- they need to sign the page. Submit with that page missing... no, easily caught as pages are numbered. This agent tried everything, whether by accident or on purpose, right from the start they were difficult. What is the seller to do, reject their offer as they did not submit the paperwork correctly within 24 hours as called for.

 

The answer to my question is perhaps falling off the roof would have been less pain. I did not go up on the roof. You do not have to be a rocket scienticst to know you can look from the inside and see if there is water stains. Their personality only got meaner and more demanding. In the end it cost the buyer this home.

 

The moral of the story is Home Buyers have a choice in who they hire. No one should be subject to demanding and mean people. The buyer lost out on the home because of who they chose and the style that person used. Buyers deserve the BEST service and better results.

Scott, I see the strategy of writing all cash and then the bait and switch. I am now adding language that states if they make a change they pay a penatly if they don't close as per the intial terms.

Every once in a while, another agent makes it into my little black book. No,  it's not that type of book.  It's a book of those agents that I will try to stay away from.  Surely, I can't say "never", but I will tell my clients about whatever horror show I know of that agent and I'll do my best to ensure that's not the agent we work with.

Good that you didn't do the roof AND work with the mean person.

Hey buddy....you went above and beyond. The house is sold as is. Let the buyer hire an inspector to climb that roof. 

I faced a similar situation today when doing an interior BPO. The house was destroyed by fire. I couldn't go inside. Most of the floor was gone. This one sits on 35 irrigated acres. I took a ton of pictures, but didn't go inside. I couldn't. that floor would have given way. This will be a fun one.

Countrywide mortgage lured me and another person into a a mortgage with a very acceptable rate and then days before closing upped it considerably. With days to close, guess who took the deal? Not to worry...they went out of business and were sued too...You reap what you sow is no myth...but a warning

Boy, I have had some diffcult ones but not quite that bad. Some agents try to maneuver and think they won't get caught. But with systems in place it will show up. Congratulations on the feature.

What a crazy story Scott, it happens. It sounds like you do a great job of dealing with tough agents. Glad you can get it out on the Rain instead of beating your head against the wall.

Our offers clearly state the terms to begin with.  Changing from cash to a loan clearly changes the offer and would require approval of all parties.  It also changes the appraisal contingency.  The mean agent or buyer would soon get a reputation, and it will affect his/her business.

Hi Scott -- our California purchase agreement has language that addresses some of the trickery that can be used but as we know there's always something new(or old with a twist) that pops up in many transactions.
