Why do you even do short sales?     

We have heard this question time and again over the years from other REALTORS.

Recently, we heard it from an uninformed and obviously frustrated buyer at the closing table.

Obstacles in closing on our short sale listings can occur despite our numerous warnings :

  • about making sure a buyer is not under a time constraint to be in a home...
  • about not writing dis-allowable costs and settlement fees into a purchase agreement that the U.S. Department of HUD will kick back...(this list is public knowledge for all FYI).
  • about request for a variance of the above list can be negotiated however it is not always approved...
  • about not sharing the updates we receive and forward from the Bank /Lender or HUD ....
  • about the making last minute changes in a short sale approved HUD-1 closing statement that then will require re-submission and YES re-approval by the short sale lender... 
  • and the list goes on!

Despite the sarcasm we occasionally experience by those with unconscious incompetence,

we do short sales to help the SELLERS!

Thanks for sharing your experience with short sales.

Some home owners are worried about the tax consequences of debt cancellation since congress has not yet extended the protection for 2015.

Good point Roy, We strongly urge our short sales sellers to obtain legal advice on the consequences of a short sale before listing as this is outside our scope. Lately our short sale listings have come by referral of local bankruptcy attorney after they have already met with the client and discussed consequences.

My question is: why not to do a short sale if a homeowners face foreclosure? Walking away or sitting and waiting to be kicked out( huge credit consequences!)~ those solutions have no sense.
