Sometimes us Realtor's make transactions so much harder than they need to be.  Working as a Buyer's Agent, it is my duty to make sure my Buyer's rights are not taken away.

 

After looking at a few homes my Buyer's decided on a home and their offer was accepted.  Included with the disclosures was an addendum, the Seller insisted the Buyer must use their title company.  If the title company was going to provide an incentive for my client to "want" to use them, then my client would consider it was my response on the addendum.  Seller who is also the listing agent crossed it out and advised either the Buyer's use his title company or no deal!!!

 

Handcuffs.jpgClearly, the Seller/Listing Agent wasn't familiar with Title 17-607 which states a real estate Agent cannot require a Buyer as a condition of settlement to use a specific settlement company, title insurance company, escrow company, mortgage lender, or title lawyer.  The penalty if found guilty is a misdemeanor, up to $5,000 fine and up to one year in prison. 

I don't know about anyone else, but that is just not worth it to me.  The Seller/Listing Agent said he wanted to use his title company because it was more convenient for him and doesn't understand why there was an issue.  I had to in several email communications remind the Seller/Listing Agent of the Buyer's right to choose the title company.  He did not back down until I sent a copy of the title which included the fine and jail time.  I guess that made him think if it were worth it too!

OH MY GOODNESS! I cannot believe I am reading this from a Realtor!!!!

If you ever come to Colorado I am sending you business as you actually get it and  many "Realtors" make things MUCH more difficult, if not downright WORSE, because they are clueless to the industry they are supposed to be "experts" in?!?!?! While I know that does not apply to Realtors in the rain lol I run into foolishness ALL the time!

Some agents just do not use the law.  It would have been smarter to do what Fannie mae does.....say they won't pay for title costs if they do not use theirs.

Tabitha, it's usually a situation where the "seller" doesn't care.  But the listing broker gets some kind of goodie from the title company.

   Forcing a Buyer or Seller to use a particular Title Company is a CRIME.  

    It is also risky (for Liability reasons) to recommend one particular Lender, Home Inspector, Surveyor, etc.

As an Agent it is so very important to know and understand the laws that govern our industry.  It is even more important to know the laws that can get you prison time...

@Joan I am not familiar with the laws of any other state but in Marylan it can be found under Title 17-607.  It is a misdeamenor punishable by up to1 year in jail, up to $5k in fines and your license van be revoked.

Most buyers have no issue with using the seller's choice of title company down in Florida since there are closing costs that the seller then has to pay for. When you can save money, it is easy to let the seller choose.

Hi Barbara-Jo Roberts Berberi, MA, TRC - Greater Clearwater Florida Residential Real Estate Professional   I'm not sure what the laws are down in Florida but the title work done is for the benefit of the Buyer so the Buyer has the right to choose.  Some Sellers/Listing Agents would prefer to use there title company for convenience or what ever the reason, but here they cannot force the Buyer to use their company... 

 

Many "Seller" will offer an benefit to the Buyer to chose their title company and that is fine as long as the Buyer still has the choice!
