Are snakes a material defect? I only scanned through this report and lawsuit, and it's obvious that many people are at fault. My first impression was " big deal" , we see black snakes in houses all the time around here. The news reported that they found 8 snakes. Maybe there were more inside the attic and walls. This has been blown way out of proportion. The snakes usually leave on their own. The house could have then been sealed up. So many questions. Why would the agent tell buyers that there were no snakes in the house? Why would buyers carry machete to kill blacksnakes? Why didn't buyers see pest inspection report? Why didn't home inspector notice snake activity? ( assuming they had enough brains to do a home inspection). Why would buyers take the word of a pest company employee who advised them to have the house gutted to analyze insulation? So much exaggeration going on from all involved.
But the bottom line is, there is a lawsuit in the works. One that could have easily been avoided. Whether or not the buyers are awarded 2 million dollars remains to be seen. But agents, brokers, and sellers will most likely be spending thousands of dollars in attorney fees to defend themselves.
I know of a house a few miles from here where we carried 35 black snakes out and turned them loose in the woods. Husband, wife and two kids moved in and still live there today. Snakes found new homes.
Black snakes are beneficial, and they are usually more afraid of you, than you are of them.
