New MD Homeowners Suing Realtor and Seller Over Snake Infested House

Are snakes a material defect? I only scanned through this report and lawsuit, and it's obvious that many people are at fault. My first impression was " big deal" , we see black snakes in houses all the time around here. The news reported that they found 8 snakes. Maybe there were more inside the attic and walls. This has been blown way out of proportion. The snakes usually leave on their own. The house could have then been sealed up. So many questions. Why would the agent tell buyers that there were no snakes in the house? Why would buyers carry machete to kill blacksnakes? Why didn't buyers see pest inspection report? Why didn't home inspector notice snake activity? ( assuming they had enough brains to do a home inspection). Why would buyers take the word of a pest company employee who advised them to have the house gutted to analyze insulation? So much exaggeration going on from all involved.

 But the bottom line is, there is a lawsuit in the works. One that could have easily been avoided. Whether or not the buyers are awarded 2 million dollars remains to be seen. But agents, brokers, and sellers will most likely be spending thousands of dollars in attorney fees to defend themselves.

 I know of a house a few miles from here where we carried 35 black snakes out and turned them loose in the woods. Husband, wife and two kids moved in and still live there today. Snakes found new homes.

This is silliness.  I find snakes (or evidence of snakes) in houses all the time.  I did one with Lenn where we found an 8' black snake in the cellar and the buyers weren't really that upset.  But if snakes don't want to be seen, they won't be seen. 

To sue over snakes in the house is silliness.

Hi Jay, Good to see you back! I agree, it is very silly. I'm betting there will be a counter suit against buyers. This whole scenario was mishandled.

I agree with Jay Markanich . It is silliness. People are simply too scared of snakes and spiders. $2 Mil scared :)

Thanks Jeff.  I am recovering, slowly.  It is a long row to hoe.

I have found snake skins in attics before and never did see the snakes.  They would only go there for food.  Once the food is gone the snakes have no reason to stay.  So seal up the house to prevent the critters from getting inside and the snakes will not (or could not) hunt there.

What if in the house in this article the inspector had seen snake skins, but not snakes, and noted it on the report.  What would that mean?  How old were the skins?  Were the snakes still around?  Would that have absolved anyone of this perceived liability?

#3- Hi Claude, we have copperheads and rattle snakes about 1 mile West near Short Hills, but mostly black, garter, corn,milk, and water snakes around here which are all harmless. There's an old saying, if you see black snakes, you probably won't see copperheads. The 2 million dollar suit is ridiculous.

#4- Hi Jon, I agree with Jay as well. I'd rather have black snakes. I opened our closet one day and 2 black snake were hanging over the closet pole. They came up from the cellar athrough a crack around a plumbing pipe, and they left on their own.

#5- Hi Jay, That's good! I read the lawsuit, and it does state that buyers had a home inspection and a pest inspection. I think the buyers knew there was evidence of snakes in the house when they bought it.

I don't know anyone comfortable around snakes. I have several snake holes in my flower garden bit it doesn't stop me from gardening. I do think it would fall under the pest inspection., too.
