WHAT ARE THE SELLER DISCLOSURES?
Once you have a written agreement with the buyers they will begin the due diligence process, including the physical investigation of your property (e.g., inspections). A big part of that due diligence period is reviewing Seller Disclosures. (Note - this discussion is specific to California; here in Southern California these disclosures are provided after the offer has been accepted)
Some Seller Disclosures are mandated by California or federal law, although there are some exceptions depending on who the seller is and the type of property, and in some cases the age of the property (e.g., the federal lead disclosure is for homes built prior to 1978).
Most seller disclosures are informational (e.g., Market Conditions, Statewide Buyer and Seller Disclosure, Local Area Disclosures for San Diego County, Water Heater and Smoke Detector Disclosure, Carbon Monoxide Disclosure); all you have to do is review and initial/sign them. Others seller disclosures provide specific information you are required to share about your property.
The most important of these is the Seller’s Transfer Disclosure Statement (TDS), required for residential properties of 1 – 4 dwelling units. You are required to disclose, in writing, a wide range of information about your property, including known defects and any repairs or remodeling inside and outside. Any “Yes” answers to these questions require an explanation (e.g., there is an HOA).
A similar disclosure, called the Seller Property Questionnaire (SPQ), asks you to respond to 4-pages of questions about the condition of your property, with additional information that is not requested on the TDS. Again “yes” answers require additional explanation (e.g., the dishwasher was replaced in 2014; the AC unit is not working). You should be as thorough as possible, and not leave anything blank.
