Judge Ruled Agent Must Buy New Corian Kitchen

Why did the Judge make the agent buy a new Corian® kitchen?  Because the listing agent advertised the home for sale as having Corian® countertops in the kitchen. Guess What?  They weren't.

 

This happened back around 2003  / 2004 in Houston when I was first starting out.  A couple bought a home in WestU that was marketed as having  Corian® countertops. About 8 months after  the buyers purchased the property .. they chipped the countertop ... and Corian® just doesn't chip like that one did. 

 

Sooo.. the owners, who were both attorneys, went to court suing the Listing Agent, Listing Broker and The Seller and it ended up that the homeowners would receive a new Corian® kitchen,  due to the fact a Corian® kitchen had been represented as a (prominent) feature of the home they purchased.

 

Many of you most likely know that Corian® is a brand name and unless it IS Corian® you can't use that word in your description. Use instead a generic term like "solid-surface counter tops".

 

BUT ... I've noticed a number of other areas that still seem to trip up listing agents.

 

JACUZZI®

Like Corian®, Jacuzzi® is a brand name and it is not just an adjective to be used to describe a bathtub. If you don't see the logo plate on it, don't call it a Jacuzzi®--- the same goes for the outdoor spa attached to the side of the swimming pool ... refer to it as a heated spa ... not "a Jacuzzi". 

 

For your bathtubs if it has nozzles you could use "whirlpool tub" if it has tiny holes in the bottom, try "jetted tub" or "airjet tub".  In all cases you are best when referencing the brand name, but if you can't see it ... go with a generic description and err on the side of caution.

 

CARRARA or CARRERA WHITE MARBLEWhitemarble

All white marble is not "carrara marble" this is not an adjective to describe white marble. 

 

Carrara marble (and Calacatta) are white marbles with grey markings that are imported from Italy.  More specificially, they can ONLY be called Carrara or Calacatta if they are quarried from that specific region of Italy.  If you don't know .. just call it "white marble"... because you for sure don't want to be in the position of paying to import white marble from Italy!

 

[BTW this is an excellent article by Debbie Snider showing you the difference (with photos) between Carrara and Calacatta white marbles --- in my mind I think of Carrara as vein-ey and Calacatta as swirl-ly .. but take a look]

 

 

SALTILLO Tiles

Like Carrara marble, Saltillo tiles are only ones imported from Saltillo, Mexico. If you don't know for sure, use a generic description .. "10 x 10" terra-cotta tile floor"

 

 

 

 

CRYSTAL

Crystal is defined by its lead content (and manufacturing process), neither of which you can tell for sure just by looking acrystal_chandt it.

 

If you see the mark ... Waterford®, Schonbeck®, Lalique®, etc. by all means use the brand name as these are well-known and coveted by collectors. 

 

But if you don't know .. just describe the feature without using the word "crystal" ... ie. "Multi-tier candelabra chandelier with electric candlestick lighting, and cascading prisms and drops".

 

 

 

 

HARDWOOD FLOOR

All wood floors are not "hardwood floors".  If you don't know it's a hardwood and don't know the difference .. please don't describe it as a hardwood floor and risk having some day to pay to have an oak floor installed.   Just say "wood floor"  or "wide-plank wood floor" or "wide-plank wood floor with dark espresso stain" or whatever its features are. 

 

Here is a link as a reference of hardwoods/soft woods to help. But particularly in the South -- a lot of floors are pine --- and that is not a hardwood.

 

 

 

WOOD CABINETS, PANELING and MOLDINGS

Mahogany is expensive and if you think it might be mahogany ... ask and verify.. it may be "mahogany stain"... but you're going to end up having to buy a mahogany door.   The same with all cherry-colored wood .. chances are good (particularly for cabinetry) it is NOT cherry wood and if you don't know use a generic phrase like "cherry-stained wood cabinets" and NOT cherrywood cabinets .. BIG difference.

 

CEDAR CLOSET

If you describe something as a walk-in cedar closet there is an expectation that there is REAL CEDAR WOOD in that closet and not "cedar smells".  Little cedar blocks hanging on the clothes hangers does not make it a cedar closet even if the seller calls it a cedar closet.  And, I better see some cedar planks on the walls and ceiling before I'm calling it a cedar closet.

 

ANTIQUE

It has to be over 100 years old to be classified as an antique. If not , use a different descriptive word and avoid using "antique".

 

Please always err on the side of caution when describing the features and finishes of a home ---  and check and verify what you are told. We operatate in a very litigious culture, so be thoughtful with the words and phrases you use to describe your properties.

 

Document the source!  If the seller tells you its Carrara marble ... explain to them via email that you can only call it Carrara if it was imported from that region of Italy ---- so your explanation to them is in writing ... and their answer BACK TO YOU will be in writing as well. 

 

If they confirm it is indeed Cararra --- at that point you asterisk the occurrence "Carrara marble* countertops --- and at the bottom of the page or in the footer * = Seller -----  indicating the Seller is the source of information (and you have your email back-up in the event there are ever any questions in the future. )

Wow - what an eye-opener.  I try to verify specific and unique items, but it's true that just because it looks like (whatever) it might not be for sure.  I, for one, don't want to buy a big ticket item due to negligence like this.  

Also, just because the seller says it so, doesn't mean it is.

I think by sheer volume "Jacuzzi" is the most misused and Corian would be right behind it.... and third in line would probably by crystal (but I work a lot in the high end market and many homes have multiple chandeliers throughout the residence.  Thanks for stopping by and commenting.

I always use generic unless I'm staring right at the logo plate on the item and then it kind of depends on the brand on whether I mention it by brand. I work mostly in the high end of market and Thermador, Gaggenau, Miele, SubZero, BainUlta, Grohe are all brands I'll use.. Whirlpool, KitchenAid, Moen, ...not so much. HOWEVER ---- KNOW your market and emphasize the brands you have that will resonate with your target market. Thanks for your comment.

The ruling is suprising to me in a way.  But it's interesting to read about these things.  I see it all the time with the "name dropping".

You make a great point and some do learn the hard way how to describe homes and what is inside.  I see those name brands used all the time when they are clearly not.

Sharon, Technically, the marketing materials are part of the contract transaction .. so yes...people need to be very thoughtful and purposeful when they create the marketing materials, which serve as an inventory of the property .. or be prepared for the consequences.  Thks for coming by and commenting.

Your MLS likely has a disclaimer that covers THEM from publishing erroneous information on their network and propagating it to other networks, portals , aggregators, etc. when they export the data. That has nothing to do with you who CREATED and are responsible for the content. The agents choice boiled down to (1) I'm an idiot .. and didn't know I couldn't call all solid-surface counters Corian (2) It was an error .. because I'm sloppy and didn't pay attention to an important detail that is a material fact in the house or (3) I DID know and figured nobody would know the difference or care (indicating intent and fraud).  NONE of these is a good place to be in. But since # 3 will likely result in add'l damages due to intent --- as well as an inquiry from the lincensing /ethics bureaus --- affirming in court you are indeed an idiot (#1) or a lazy and sloppy agent (#2) may be your best options..... for a totally AVOIDABLE incident.  EEPS!!!!

Well deserved feature. I see these "mis-representations" come about all the time. It's like the difference between Kleenex and tissues. Not all tissues are Kleenex. Or Xerox and photocopies. Not all photocopies are xeroxes. The one we see a lot of here, besides Corian which is a brand name, is Jacuzzi, which is a brand name and does cover all of the jetted tubs on the market.

Nina ..  I still call all tissues Kleenex and probably always will ... hee hee. And I agree with you .. I think Jacuzzi is probably the most mis-used .. which is a bummer considering how much they cost -- in the event an agent is made to install a Jacuzzi because that's what they said was there --- particularly the BIG RASCALS on the side of a pool!  Thanks for coming by and commenting.

Agreed ... that's one of the first things people say these day ..."I'm going to sue..."but then again if you paid $1M+ for  a home belieiving you had (the benefits of) a Corian kitchen.. and then it chipped and you knew you were misled --- that can't be a good feeling, either.  Thanks for coming by to comment.

WOW! Best post ever when it comes to using descriptions in the MLS!!! I really wish the pull down choices weren't in MLS because it's so easy to just look at the choices without stopping to think about it or ask.

When in doubt - DON'T! The consequences are greater than the commission to the agent, Broker & Seller based on sales price.

This was truly FEATURE worthy!!!

Great things to keep in mind, thanks! This newbie-to-be sure wouldn't want to make such a mistake and have it bite back at a later date. Hopefully, I'll remember this and learn to keep my descriptions generic from the get-go, or get seller documentation for any brand names used. :0)
