Many real estate agents, REALTORS®, and brokers are using social networking websites to notify their “friends” and “followers” of property listings. While this act seems innocent enough, the real estate agent could be violating state law, National Association of REALTORS® Code of Ethics, MLS rules, and possibly federal law without knowing it.
Most Real Estate agents do not even know the Potential Violation of NAR Code of Ethics, yet they outsource to novice social media service providers who are out there representing their name and brand. Legally speaking: Stay within the ‘rules’ when advertising your real estate services.
Did you know that legal regulations regarding social media for Realtors varies from state to state? Let’s start out with the simple one. As A social media manager, expert, trainer and speaker I get asked this question a lot. “Do you have to display the Broker’s name on all print and web/online advertising?”
The answer is: Yes and No. This means that it is different in every state in the US. I market for and represent Real Estate agents all over the US. It is my business to know the Real Estate marketing laws in all 50 states so that when effectively marketing and creating a power brand for my Real Estate clients I am not violating the markeing laws of their state.
