Barnegat Property Tax Appeal for 2016

All Barnegat property owners should have received a “Notice of Property Tax Assessment for 2016” by now. If you disagree with the 2016 assessed value of your property you have the right to appeal to the Ocean County Board of Taxation.

Your 2016 Barnegat Tax Appeal must be filed with the Ocean County Tax Board on or before April 1, 2016. Barnegat Township’s Assessor’s office does not carry the appeal forms; you must obtain the forms from the Ocean County Tax Board.

As part of the appeals process, you must provide “Comparable Sales.” Comparable sales can be obtained from the Barnegat Tax Assessors Office at no cost or a local Barnegat Real Estate Agent could also provide the information, also at no cost.

In reference to comparable sales: Not more than five comparable sales shall be submitted to the assessor, clerk and county board not later than seven calendar days prior to the hearing if not included with the petition of appeal. The information regarding each comparable sale shall include the block, lot, sale price and deed date.

You must be prepared to discuss the comparable elements of the sold properties as compared to the property under appeal. This includes, but is not limited to the: 1) location; 2) quality and condition; 3) comparability of model/size (square footage); 4) comparability of features (number of bedrooms, number of baths, etc.). Photographs are always helpful to the Board.

You should be prepared to address the legitimacy of the transaction i.e. sellers who are not influenced by extraordinary issues (foreclosure, bankruptcy, and transactions between related parties, etc.).

Note: There can a big difference between "Market Value" and "Assessed Value" of your home. The market value is how much your home is worth currently on the market and the assessed value is typically based on a percentage of the appraised value which is used to determine how much property taxes you will owe on your home. This is usually a point of contention when the assessment arrives in the mail because most homeowners don’t agree with the taxes stated as due.

The burden of proof falls on the petitioner who must present comparable sales to prove market value of the property.
