How To Handle Agent to Agent Referrals Properly

 

 

Referrals are part of our business model and have been for many, many years.  We have How To Handle Agent to Agent Referrals Properly outgoing and incoming referrals from ActiveRain, CRS and other groups. It is always an honor to receive referrals from agents we know, like and trust. The referring agent knows that we will take the very best care of the clients they're referring. And we also know that the agents we refer our clients too will receive exceptional service as well.

 

  

What is the proper way to handle a referral?  When I become aware that a client of ours is moving to another location I immediately locate an agent in whatever area they are moving to. I first call the agent and talk to them about my clients and their wants and needs to make sure it's a good fit (if I don't know the agent already). I then follow up with a referral agreement signed by both parties. The agent and I keep in touch and help each other out, if needed, until the transaction closes.

 

 

 How To Handle Agent to Agent Referrals ProperlyA few months ago clients of mine that had moved to Texas 4 years ago, called to let me know they're moving to the Fort Collins area instead of back to Phoenix. They were going to rent for the 1st year and then intend to buy a home.  I immediately contacted Dick Greenberg as I knew he and Mary would take excellent care of my clients. Even thou they won't be buying for another six months or so at this point, setting up the referral in advance  gives the clients a good sense of 'we've got somebody' we can rely on from now until we buy.It might be just a matter of setting up MLS searches, occasional emails and, of course, putting them on the newsletter list.  It's simply a good business practice!

 

 

How NOT to handle a referral?  This past year an elderly man from CA called me letting me know he got 'stuck' with a property in Phoenix and he had no idea of what to do. We get a number of calls like this as people find us online, so his call didn't seem unusual to me. His situation was quite complicated and it took some time working with an attorney and others to even begin considering offers. All went well and we closed the transaction  last November. Last week an agent from CA called me and said "I don't expect anything but I did give your name to this man a year ago".  Well that's interesting was my first thought. My second thought was -- and you waited over a year to call me? It's simply NOT a good business practice!

 

 

What should have happened?  This agent should have contacted me right away regarding the possible referral.  At the very least a simple phone call from the agent would have sufficed! I would have known it was a referral and honored it, of course. AND this is a BIG AND - I would have made sure a referral agreement was in place, that it was part of the transaction and that is was handled properly through escrow.  Agent to agent referrals are part of a contract and proper contractual procedures must be in place for each and every referral. It's simply a good business practice!

Great Advise!  I have had the by the way my daughter is an agent you'll be paying her a referal after going into contract.  Really why didn't she send me a referal agrentment in the begining?  Why are you tell me this now? It did accure to you or her before we got to this point?  

I do call ahead an speak directly to an agent to make sure they are a good fit for my client.

Manu Oberoi you're welcome.  I'll email you a form and you can change it to whatever your broker thinks is appropiate for the firm.  They might already have a form - most do.

Anna, This is a great post. It is always good to have the "pre-referral" conversation and date and document. Let the communication begin. One of my past brokers gave me a referral referred to them. I ended up paying the referring company a fee and then my broker a referral fee. Another reason I am no longer with that brokerage.

If they do not say anything in advance all the get is a thanks.  generally I would call you first before I passed on your name, but if for some reason I had to give them a name right a way I would have called you ASAP to let you know I had passed your name on and to work something out.  I have done things informally with other agents in the past.  Getting the actually written agreement later.

OH MY GOSH!  Is this the latest shake down of agents?  I've become so jaundiced with these things.  I get WEIRD texts now . . . "Will you accept a buyer in your area?"  WTF is that supposed to mean??  I have no idea who the person is who is texting me, I have no idea about the "buyer" . . . and I won't accept anything via text.  I email back and asked the agent to CALL ME TO DISCUSS and they text back saying they were busy and couldn't.  Odd.  What bothers me most is the brazen SCAM that someone was trying to pull over on you.  That's how I see it.  A SCAM!  If agents can assert a claim simply by saying "Hey I referred you to that client, you owe me" it's sounds like a shake down/scam to me.  And as Wayne Johnson writes: if it's not in writing, it didn't happen.  TEXT is not written agreement of a referral . . . nor is a phone call a year later.  OY VEY!

If they're too busy to 'discuss' it's probably a relo company trying to sell you.  This gal actually was polite and she did know the people well apparently.  She just dropped the ball and never made any contact with me. OY VEY is right!

Don't think that just because that agent is on ActiveRain that makes it  a guarantee of success or even ethics.

I had a signed referral agreement with a well known, well liked, very active AR blogger.  In fact some people actually wrote blogs about how wonderful she is. 

She closed my buyers and then refused to pay the referral fee.  She ignored my requests for my payment of $19,208 she owed me. 

I took her to arbitration in HER state and got my $19,208.  She had no reason not to pay me, but did have a list of excuses.  I charged her too much, too much time lapsed, she was busy, I did not call her enought yada, yada, yada...

The bottom line was that her GREED took over sanity and she just wanted to keep the money.

I ALSO filed ethics complaints...she was found guilty.  The sad thing is that this was 7 months of nonsense while she played the victim role.  She is a broker, former board director and in this business for 20 year...yes, believe it.

She knew better but just figured that I was 1500 miles away, I would not bother.  I have no doubt she has done this before.  10 days after she refused to pay us, she was on AR bragging about getting lots of referrals...

Her biggest mistake was underestimating how much I hate dishonesty.

Eve so sorry you were put through this crazy situation. And I am  very glad your finally did get paid and took her to ethics as well.  I have run into only one AR agent that was dishonest on a referral  but I let it go as it was small and also for a family member. I couldn't believe the words that came out of his mouth - such bs.  He will never ever get any referrals from me.

Referrals that not handled well can create unnecessary resentment.  It's too easy to make a call, set the expection and get it in writing.

Chris Ann Cleland agreed. Referrals are simply a contractual part of a transaction and those that don't follow the contract will get themselves in hot water or worse.

Anna - I'm with you on this one.  I always call the agent - make sure it is going to be a good fit and then send a referral agreement.  I also like to give periodic updates to the referring agent.

Great post (as always) Anna!  I can imagine what that might have felt like, getting a call a year after the fact.  I'm working with a gal now that was referred to me months ago and I'll be processing her just as if it were yesterday, like you would handle the referral.  Makes good business sense to stay above board and handle these properly.

You could not have explained the procedure more clearly Anna.  The few that I have referred have went well, and hope that it becomes more frequent as friends retire to warmer climes.  Do they have golf courses in Arizona like they do in Florida?
