Here in Maryland there are several ways to buy a house but...

is it really "as is"?

In our ' as is' addendum you can choose to buy the house without any inspections 'as is/where is'.  What you see is what you get.

This may be an investor who is going to rehab, gut or tear it down or someone with a really good eye and background  who feels secure they know just what they are doing. Auctions are also sold 'as is' and buyers need to be  aware.

The second choice is to have an inspection with the 'right to withdraw' based on inspections. The information obtained is for the buyer's own knowledge. This assures the sellers there will be  no repair requests. Buyers feel they have gotten a great deal.

 

What if you purchase a house that seems so right for your family situation?  It's in the right location, it is the right size, it is just  the perfect house...but there are lots of 'cosmetic' things.

You negotiate a really good deal in 'as is'  condition including 'the right to terminate.'

Home inspector is thorough, spending over 3 hours at the property and sends a very detailed report with photos etc. There are 45, yes forty five,  summary items to be addressed. ( The inspector was ready to stop from the beginning but was reassured the buyer wanted to proceed.)

Those cosmetic things were not a problem.

However there was evidence of many roof repairs, an abundant amount of caulking  around all of the skylights. And there were  already THREE layers of roofing on most of the house!  

And then a note:  "Extensive Black Fungal Growth & Water Damage Exists. Water damaged plywood around skylights and other leakage affected areas will require replacement."  

There was extensive termite damage even though the house had bait traps around the outside.

I could continue with the list of major and safety issues but you get the picture. 

 

Does the buyer just terminate the offer?  

Do they still want the property?

If the report is given to the seller...will it be disclosed to the next buyer?

Where do you think this will go?

The sellers have a ball in SF Bay Area. I have not sold a single home with conditions other then the loan.  Those wanting this and that fall by the wayside. Sorry way too many offers.

Majority release all contingiencies at first time even offer rent back to have an edge.

I just sold and closed on a house "as is". The buyers had a home inspection and was good. Also the buyer's dad helped build the house and knew it was in great shape. I was so happy for this young first time home buyers.

As Sam Shueh says, our offers, to have a chance of being accepted, are always "as is" and most often with all contingencies waived. Of course, it is customary here for sellers to get a termite and property inspection reports; those are given to us along with all the various disclosures and other reports before we write an offer.

Also in California, a listing agent is required to make all reports available to potential buyers, so if a home inspection pointed out major flaws, future buyers would be aware of them.

The one thing I always do with all my clients is have a very in-depth discussion with them about what "buying as is" entails. Many really don't have a clue. Then it's their decision whether or not to go ahead with or without inspections in the mix.

Margaret well you've got a can of worms opened.  It could go several  ways depending on if the sales price was really good and there was plenty of room left to handle all the big issues plus everything else or they could walk and say bye bye OR the buyer, in spite of an AS IS addendum in place could ask for repairs and seller could actually say yes. I just had an AS IS sale turn into a repair request from the buyes and our sellers actually decided to do the repairs.....you just never know sometimes. Do give us an update!

Margaret Rome, Baltimore Maryland Our contracts are As Is with the Right to Inspect.  I've only had one who waived an inscpection, but like Anna Banana Kruchten I've had many buyers ask sellers to either make repairs or for repair credits at closing (even though they are not required to do so.)  The fact is that if the buyer really wants to buy and seller really wants to sell, it can be worked out.  If there is too much wrong on the inspection, the buyer can always walk.  Let us know how it works out.
