Discriminating Against CONVICTS Violates Fair Housing - HUH?

I consider myself to be a somewhat sane, rational thinker. I've learned to take things with a grain of salt and get on with my life. But when we start passing laws that can have serious consequences to our clients, tenants, and loved ones, you have to wonder how we have gotten so far off track.

In April of 2016, HUD came out with their guidelines for properly considering criminal records when an applicant applies for rental housing.

HUD notes that because a disproportionate amount of people
with criminal records are minorites, a blanket policy of refusing
to rent to anyone with a criminal history
may violate the Fair Housing Act.

Seriously? Yep, your government dollars at work. They indicate that an arrest is different than a conviction (brilliant), but even so, a blanket refusal to rent to convicted individuals 'probably violates the Fair Housing Act.' Here's the full article. What do you think?

    The EPA recently announced rules that will outlaw Auto Racing as we know it.  You will not be able to "modify" any car.

      Car and Driver magazine has a piece on it, NASCAR is concerned, several Congressman are demanding an explanation.

If it's built that way, as a race car, then where is the modification? The EPA needs to focus on the real -- and I mean REAL -- air, soil and water polluters.   Nero fiddles, while Rome is polluted.

Mimi- don't get me started. There are some "entrepreneurs" here who have purchased multimillion dollar oceanfront mansions for their wealthy rehab clients. I can't wait to see what happens should their businesses run afoul of the IRS or some other government arm. And of course, their neighbors just love this.

You know Mimi Foster I have been vocal about FICO scores for a long time. I think we all deserve MORE PRIVACY, not less. this is probalby a step in the right direction.

Gone are the days when you could move to a new town, change your name and start over again. It seems that you should appreciate this (being a Westerner). It is our history, isn't it?

we are becoming a nation of renters. We need to change the direction of this trend. Don't worry about these people. Let them "BUY" the house next door.

I am all for less government . . . the less the better. But I don't understand how anyone can say, with a straight face, that because a disproportionate amount of criminals are minorities, then we shouldn't discriminate against convicted criminals, who have a high probability of being a minority, because it might violate their Fair Housing rights? INSANITY.


I'm all for starting over, but (one of my favorite lines) I don't think it means what you think it means

Doesn't matter.  If someone applies and they can't pay the rent, who's going to fault the landlord?  Don't rent to them.  Don't EVER refuse to rent to anyone based on anything.  That's where people get into hot water.  Take a rental application, screen it, vet them, and guess what's the most common denial?  Don't make enough money to pay the rent.  Don't approve their application based on their inability to pay rent and that 's much different from "refusing" to rent based on [fill in the blank].  End of story. Most convicts, when released, don't have much money.  They typically are released to half-way houses.  Pity that people are put in life's circumstances.

And if they can pay rent and they just got out of jail on sexual-assault-on-a-child charges, and they want to live next door to your daughter, then whose unfortunate life circumstance do you think that will be? Is it the new neighbor or the rapist that you pity?

This will be important for property managers and corporations that own and rent out their properties to tenants. In my opinion, the law reflects we are becoming more of a renter nation than homeownership nation.

Property managers need to be very careful with their selection process for tenants. Convicted felons can vote after they have served their time and they need to be able to rent a home.

Yes, “discriminating” does qualify as discrimination. These people have served their time. Let’s not continue to make them pay or marginalize them. Housing is a basic requirement to persist in life. As for employment, the idea of “ban[ning] the box” for housing has real merit.
