Sometimes people ask me, what is it that a Seller's Agent does (?) better known as Listing Agent. What does a Listing Agent do, and what are the obligations and duties of a Listing Agent to their client?
Here we go, I want to read this to you, this is from the California Association of Realtors "Agency
Disclosure" form. It really maps it out for us there. This is what it says: Sellers Agent: A Seller's Agent, under a listing agreement with the seller, acts as the agent for the seller only. A Sellers Agent, or a sub-agent of THAT agent, has the following affirmative obligations: To the seller; A fiduciary duty of utmost care, integrity, honesty, and loyalty, in dealings with the seller. To both the buyer AND the seller, the Seller's Agent has an obligation for (a.) Diligence, a diligent exercise of reasonable skill and care and performance of the Agent's duties. Secondly, (b.) A duty of honest and fair dealing and good faith. And third (c.) A duty to disclose all facts known to the Agent materially affecting the value or the desirability of that property, that are not known to, or within the diligent attention and observation of the parties. The Agent is not obligated to reveal to either party any confidential information obtained from the other party that does not involve the affirmative duties set forth above.
So there you have it. Those are the duties and obligations of the Listing Agent, aka
Seller's Agent in the state of California.
