HERO Program - Doesn't Make You A

"Hero" To Your Buyers

 

What comes to mind this morning is the song "Another One Bites The Dust." The HERO Program seems to be another well-intentioned program which might cost the homeowner a great deal, in the long run.

The HERO Program (Home Energy Renovation Opportunity) provides homeowners a way to finance energy efficient upgrades to their homes. Because the qualification is based on energy, not income or FICO scores, the idea is to allow all homeowners to access improvements to their homes. 

Once the loan is approved, it's paid off over 20 years along with the property taxes. The idea is that the cost might be tax-deductible since it's paid as part of the tax bill. HERO is very clear to indicate that it "might" be tax deductible and that you need to check, carefully.

It's appealing to finance over a long term and have some efficient upgrades, but if you are considering a sale of your home during the loan term, it needs to be carefully thought through.

The website states that the loan is assumable by the new owners, this seems to be true. It's also allowed to be subordinated to the first loan. The problem is that lenders are wary of the program. They see the loan as being paid as part of the property taxes, so in the event of a default of taxes, HERO suddenly jumps to the top of the list for payoff, ahead of a new first trust deed. 

I don't know! 

I'm working through this issue right now with a home sale. My sellers used the HERO Program to install solar panels and the new buyer's lender is balking. We'll have to see how this plays out. In my case, there is money in the deal and willing buyers, sellers and a helpful buyer's agent. I think it's going to be fine.

But my cautionary tale!!

Home owners, please consider the effect of these kinds of decisions on the possible sale of your home. We have really reached the point where it's smart to talk with a real estate broker before entering anything like the HERO Program, Solar Leasing/Financing or any other kind of long term obligation which transfers with the property.

HERO to one, but a villain to others.

Hi Karen, this is an excellent post. I dealt with the same representing the buyers, mine were cash buyers, however, they didn't want to pay for something sellers made a commitment on and it was not disclosed properly on the sellers disclosure. Luckily, all worked out in the end.

thanks for the info Karen.  I ran into a similar problem with a solar lease and the other agent was terribly uncooperative!  One thing for people to keep in mind is that buyers may be reluctant to commit to a lease or payment plan on technology that will probably be outdated long before it is paid for!

Interesting circumstances, Karen Fiddler, Broker/Owner.  It doesn't surprise me that the Lender is balking at this.  Anything that jeopardizes their positioning for repayment of debt will set-off alarms, bells, and whistles.  Keep us posted as to the outcome of this situation ... it's definitely a learning experience.

Karen I am glad you highlighted solar panels in the blog, because some solar companies (not all) are creating issues.  I just looked at putting solar panels on my house, and I provided the salesman with the lending guidelines when it comes to solar panels.  His corporate office is looking at the guidelines, and want them to get back to me IN WRITING that the comply.  No solar panels will go up on the roof until they state they do/will comply.

Deena....typically I don't allow advertising posts,  but I want to address your comment.  The fact is that lenders will not lend right now. I just lost a buyer who could not get financing.  Additionally...add we looked into the financing.  It shows that is paid back over 20 years,  which means a $18,000 loan will cost almost $40,000 before is paid. 

I think it's pretty bad all the way around.  I would highly advise against using the HERO Pegram
