Need your help - Survey on HOAs for Legislators!

By
Real Estate Agent with REMAX Fine Properties BR525714000

Would you like to see laws changed so your clients are not having to pay an attorney to resolve HOA issues, are not made to remedy an undisclosed violation after buying into an HOA, are not hit with a surprise special assessment right after buying a condo etc.

Please take the survey and share with friends and neighbors. The survey is educational, as well as possibly addressing some possible improvements that could be made in the law to benefit homeowners. Below there is also a link to an HOA Industry Advisory that I am using so my buyers have more knowledge about HOAs before buying into one; please use or make your own version if you find the information helpful to your clients.

HOA management companies in Hawaii must be licensed.

What department handles the license there? Many states don't license them. In some states they are simply credentialed, but no license. On here http://www.allpropertymanagement.com/propertylaw/ they say in Hawaii they only need to be registered with the state.

HOA's here are regulated.  Part of our contract, seller is required at seller expense (unless agreed otherwise), to provide a complete set of up to date HOA docs as well as last 3 BOD meeting minutes, annual meeting minutes, financial, reserve study, insurance certificate etc etc.  Each year AOAO must provide the state with a reserve analysis and pay a small registration fee.  This is mainly to avoid associations from having to do some big assessment.

Thank you Bruce...I'll look at that! Maybe AZ can look at how your state has licensed and regulated HOAs in creating something similar here.
