The sale and closing process

This is a brief overview to highlight the process and is not inclusive of all of the nearly 40 steps it will take to get your property sold and closed.

Once your home is under contract there are several steps that will need to take place in order to insure your property will close smoothly


Final binding contract is sent to all parties including the closing attorney, lender, associated vendors such as inspectors, appraiser and insurance agent.

The property is placed under contract in the MLS systems and turned into the listing and selling brokers offices

The buyer will have a set amount of time to delivery their earnest money (good faith funds) to the holder as named in the contract

The buyer will have a set amount days to begin their due diligence and inspect the property and area. The buyer will hire an independent property inspector who will inspect the property and grounds and provide a report to buyer. Often times the buyer will also hire a pest control company to inspect the property for pests and termites as well as test for mold and radon.

The buyer may elect to ask the seller to make repairs to the property. If no repairs are requested, the buyer agrees to buy the home in the condition it currently is in and the seller agrees to deliver the property at closing in the same condition as of the day of contract or better as agreed in the terms of the contract at closing.

After the inspection, the buyer’s lender will order the appraisal for the property. An appraiser who works on the behalf of the lender, will make an appointment to come inspect the property and will prepare and provide a report to the buyer’s lender for consideration. They will access the property and give an opinion on value. If the property appraisal does not meet the agreed upon sales price, the buyer and/or seller may opt to terminate and dissolve the agreement or may choose to re-negotiate the price to match the appraiser value and proceed with the close of sale.

In the interim, the buyer will at the lender’s request provide any remaining docs such as check stubs, bank statements or tax returns. It is at this time the lender begins processing and verifying the buyer’s assets, income and credit profile.  This is also done prior to the buyer searching for homes but lenders in today’s market will verify any information provided by the buyer each week up until the day before closing once a contract has been procured. This is a vetting process all lenders go through due to the changes in finance and mortgage laws in recent years.

Next the lender will request the closing attorney provide a title report showing that you have ownership and the full right to sell the property to others without encumbrances on your property title. The closing attorney will ask you to provide your name, forwarding address, loan company name, loan number, social security number and information regarding any 3rd parties lien holders like your HOA, county for property taxes and water bills. If you own the property in the name of a trust or incorporation or LLC, you will need to provide documents at this time so that they can be verified. The lender or 3rd party lien holder will need to provide payoff information to the closing attorney as well.


Next, the lender will request an invoice from the buyer’s choice of property insurer and seller warranty provided so they will collect those fees up front at the closing from the buyer and you if you agreed to provide a home warranty at the close of sale.

If you are required to make any repairs to the property, this would be the next step for you to complete.  Once they are competed the buyer at their option may choose to do a final walk through or hire their property inspector to re-inspect to make sure the repairs have been properly made.

Next just prior to closing, the buyer’s lender will prepare what is called a Closing Disclosure. It will break down all of the fees associated with the sale. The closing attorney will review it to make sure all of the numbers are correct.  Once that is completed the selle will receive a copy of the closing disclosure with the amount that is due to the seller or due from the seller in the instance where the home is selling for less than the amount that is owed by the seller to their 3rd party lien holder or lender.  The buyer will also receive a similar document that will state the amount they will need to wire to the closing attorney prior to closing.

Next, if the property is a home, the seller will need to prepare to move from the property and have the home cleaned, as well as make any last minute repairs or replacements as per the contract.

Next is closing day.

Prior to your closing, you would have received your closing statement with the amount you will expect to walk away with or will need to bring to close.  You will enter the closing attorney’s office (directions will be provided) and then walk up to the receptionist and let them know you are there for closing your property. They will ask your name, the property address and ask for your ID. You will then be asked to have a seat in the lobby or at the closing table and wait on the closing attorney to come to greet you and give you any needed instructions.

It is important to note that in the State of Georgia, in transactions with a lender involved, the closing attorney works on the behalf of the lender. In cash transactions, the closing attorney works on the behalf of either buyer or the seller and is determined in the contract upon binding agreement.  It is customary in cash deals that whoever pays the attorney is represented by that attorney unless the contract was agreed upon differently.

At the closing table, if all parties are present you should be there with the closing attorney, the buyer, your agent, the buyer’s agent and possibly the loan officer.  The standard closing takes 1 – 2 hours based on the volume of closings at the attorney’s office and the time of year. Summer closings as well as closings involving FHA or VA financing typically take longer as there is a higher volume of closings happening and VA and FHA financed deals have considerable more paperwork as they are governments backed loans.

Once the buyer and you have signed your respective documents, the attorney will notarized the, the forms and  send them for final review to the buyers lender (if applicable),  verify that the buyer’s funds have been received to fund the transaction and will send payment to your lender and/or to you to complete the sale and transfer of property. Next, the attorney will disperse funds to the remaining parties and then close your escrow. You will then give the buyers the keys, garage openers or gate codes and at that time your property will be SOLD!  You lender will be wired funds to pay off your mortgage within 24 hours after your closing. You will receive confirmation from your lender that the home was paid off within 7-10 business days after your closing depending on the lender. It will be reflected on your credit report within 60 days.

As a California native, Jackye relocated to Georgia in the mid 90's to initially attend school but stayed and fell in love with Atlanta and the different styles of architecture available in southern homes and estates that simply do not exist in California. She has found that Atlanta living offers a certain quality of life that cannot be easily described in words, but only seen and felt in the charming neighborhoods and suburbs around Atlanta. 

Focusing on upwardly mobile professionals, Jackye has created a specialized niche of what she calls, "The Neo-Suburban Upscale Client". This niche of clientele are those who appreciate and desire,  newer and well kept, quiet pocket neighborhoods, throughout the area that are hidden away, yet within minutes to all the area has to offer without the inconvenience of a commute. There are hundreds of these quiet neighborhoods just barely tucked away throughout the metro area. The comments that Jackye hears most often from clients are, "I didn't even know this was here!" and "I've been here my whole life and have never heard of this neighborhood!" Jackye and her team spend close to 10 hours a week searching  and finding these neat little neighborhoods to list and showcase to buyers.

Jackye has been a featured agent with HGTV for over 4 seasons and brings a fresh approach to sales and entertainment beyond the traditional route of real estate. She has developed multiple real estate courses over the years and trained hundreds of agents on the perfecting their selling and marketing techniques. She also has the distinction of being the first agent in Atlanta successfully using the technique of Specific Reverse Real Estate Marketing in gaining prospective buyers for the properties she lists and sells. She developed the technique when she noticed a void in real estate marketing where the buyers who wanted to buy specific property simply weren’t being heard.
