A Preliminary HUD when listing a Short Sale Is a Good Idea. I usually have my title company do a preliminary HUD 1 when I list a short sale. Just reticently, I am representing a buyer on a short sale. The negotiation has gone on for almost 4 months. We finally got an approval. While we were doing our home inspection, loan final approval, and appraisal, the listing agent calls and informs me that there is an additional $10,000 lien on the property and he now has to negotiate that. My client is now spending money, and this closing isn't for sure. I believe that the agent will get it negotiated, but all of this could have been avoided at the last minute with a pre HUD.

Mark- I can not believe that a listing agent would not get the HUD1 at the time that the short sale package is initially sent in! Most lenders will not even look at the package without an updated HUD1. Our title co projects out the HUD for 90 days to cover our seating section! If there are items that are not put on the HUD, then the agents have to pay those or else the deal does not close. GET A HUD! 

If I were representing a buyer on a short sale, I would make sure from the beginning that all the correct docs were sent in. I would ask to see the HUD, since my commission needs to be on that HUD too! Katerina

My coach says stay away from Short Sales...too much time and no guarantee they'll even pay off.

Sometimes a PreHud isn't the answer you are quite looking for. When taking a short sale listing, start right away with a full search regarding the title and liens, & check back often for any additional liens that may show up along the way. I do know that a short sale won't be accepted until a PreHUD is completed, but that doesn't stop a lien from popping up down the road. If this lien was there all along, then the title search made an error of not finding it. But I have seen liens come up at the last minute. Katerina- The title company did do a hud1, but they didn't investigate the title for additional liens. Using a title company that understands what is at stake should be my next blog.

Bryan- If you are not experienced with them I agree, but they can be negotiated fairly easily if you have the patience and follow up.
