Eager Beaver Buyer Does a No No

It happened to me today.  My eager buyer (Mr. Buyer) called the Listing Agent from the number on the "for sale" sign of a REO while he was "scouting the neighborhood". This is when the Buyer's Exclusive Representation Agreement comes in handy.  Not only did the Listing Agent not ask over the telephone Mr. Buyer if he already had an agent, but, after she drove 30 minutes to show the property and THEN asked if he had an agent and he replied, "yes", she still proceeded to tell him that it would be a good idea to go with her because "he'd get a better deal" on the purchase price. (By the way, the story from my buyer was that he called the agent and he wanted to see the property and she said that she was going to be in the area at 9am and could meet him there at 10am.)

Has this market become so tough that the agents are now acting as ruthless individuals and not following the NAR's Code of Ethics?  She must have skipped through and not read Article 16 of the Code of Ethics that states: "Realtors shall not engage in any practice or take any action inconsistent with exclusive representation or exclusive brokerage relationship agreements that other Realtors have with clients."

I know, I know, shame on my buyer for acting on his own. He knows better now, because he wants to make an offer on that house and now the Realtor is making it difficult for me OR Mrs. Buyer to see the property. The Supra key is non-operable (she hasn't activated it) and she won't give out the combination on the combo lock on the door because she said that the lender won't allow her to release the number to anyone. Hmmmmmmm. Then why have it on the door?????  Makes no sense to me.  We'll see how this pans out!

Your have an ethics grievance well in hand, Linda, and it would serve the community well if you intercede with your local board. Clearly, standards for professional conduct are being ignored.

Good grief!  I can't imagine having the nerve to do that.  I know an agent who actually told me she tried to get a buyer to go with her, AFTER they had visited an OH with their agent.  When I was shocked and let her know, she said that's how this business is.  Very sad.

Have you checked to see if she is a Realtor and not an agent. Yes we are seeing the true colors of many Realtors now a days.

I agree with Lynda and would call her broker. This market has brought out more unethical behavior...it's been (as I call it) a "free for all".

File the greivance let all know that doing this will result in grievance being filed most think they will get a hand slap from their broker after its done with they get a high five from the broker especially in this market . This is just an opinion.

I am a member of a professional standards and ethics committee and served 2 years on a grievance committee.

I personally think you have a duty to report it

I'm sure that the buyer just made an innocent mistake. However the listing agent amazes me. I would think that in this market the listing agent would be happy to show the home and hopefully get an offer. How stupid of her to play games with a prospective sale.

Read this after reading the update on the story.  Wow, sounds like this Realtor was only looking out for themselves, which will come back to bite them in the end.  Would be interested in an update after you know what the local board is going to do.  Best of luck!
