The agent or broker who pinned the price on the property donkey could be too low so the paying above listing price hesitation needs to be addressed. The higher number could still be a good deal if the limbo pole was too low to begin with... the market has spoken on the end result value of the day.

Donika - thank you for the detailed list. These are all things that my top Realtor referral partners discuss with our clients. I think someone mentioned it in an earlier comment, but a cover letter from the buyer's agent as well as "why we would like to buy your house" letter from the buyers seem to go a long way too.

Yes, anything that can touch the seller's heart and make them like one particular buyer over the others helps and the same holds true for the buyer's agent letting the seller's agent know why their client is excited and very qualified to buy the house. In order to win in some areas, it seems that the winning ticket is to remove the appraisal contingency. I lost a few to buyers doing that and then I won one because I had a buyer who was able to do that. Not all buyers can do that but for the ones that can, it can help a lot.
I think it also helps in some cases to present your buyers as nice human beings. Sometimes you get lucky and something personal seems to touch the seller and makes them go for one buyer over another.

Yes, removing the appraisal contingency is a strong point in the buyer's favor. I had a cash offer on a listing recently where the buyer made it contingent on appraisal (and a bunch of other things), so the seller ended up rejecting it. Adding a personal touch definitely helps. I should have added that to my list actually. Thank you for commenting!

In my area, I'm always surprised by the amount of agents who use the default number of days for inspection period (on our As-Is contract it's 15 days). There is no reason why inspections can't be performed/completed within 7-10 days MAX. That contingency alone can mean the difference between winning or losing a multiple offer situation, all other terms being equal.

Yes, here's where an agent can shine or flunk. Yes EM sends a message. How about a 10% deposit? I like having the buyer write a note to the seller saying how much they love the home and the neighborhood. It's been said ''we don't sell real estate, but we sell people to people."

In NYC supply in most neighborhoods is barely existent, and demand is intense. Comps are getting thrown out the window in many cases and all cash is routine. Any information that can help a buyer overcome multiple bids is useful.

Great tips. I'd make one minor modification and say "the higher the earnest money, the more interest you show in the property." I'd also suggest adding a line that says "contact the listing agent to discuss what terms and service providers the seller would like to see." Giving the seller one thing less to counter is always a plus.
