Egress and Ingress ROW Right of Way Land Abutting

 

Egret Not EgressThe research continues into whether someone who bought the property within a ROW but not outside the ROW can prevent a land owner with land that abutts the ROW from Ingress and Egress from the ROW to their land. And No, Egress is not a bird... that's an Egret! :)  It does seem to be a common mistake though, just do a Google search for Egress Bird.  

 

Hopefully an answer soon!

 

My client owns land abutting the highway, it is for sale.  Of course the price should be a better price if he has the right to install a driveway onto the Right Of Way.  A few lookers have questioned that right, hence it is still for sale.

 

I've had him consult with his attorney and other authorities..  nothing clear yet but we may have an answer soon.  

 

Each day brings new lessons in real estate even after 16 years!  

 

Right of Way issues actually come up fairly often in my neck of the woods. Between that and fences, the boundaries are always being questioned and while a survey can cure the boundary questions relating to fences, it's not quite the answer for access to Right-of-Ways.
