Should Dolly a Tenant Seek Legal Council?

Dolly rents second floor condo it is a three story building . One morning she receives a call . We were knocking on your door wake up there is a flood . The lady upstairs overflowed her washer . Oh no she jumped out of bed ran out to the laundry area and water was pouring out of the ceiling and the carpets were wet . Just what she needed on her only day off .
Well we all know what it is like to have an accident like this happen in a home. In an apartment or condo you are renting in my humble opinion should be the landlords responsibility to fix and take care of. That is why people rent instead of own .You will understand when you read the rest of the story
The woman upstairs it seemed had overstuffed her washer with bedding and clothing causing it to
overflow . The maintenance man from the condo shut off the water stopping the flow of water that had come down into second floor and first floor unit .It was really a mess. Later the lady turned the washer back on after taking the bedding out to see if the washer still worked and water continued to flow down to the the second floor unit and the first floor unit and had caused severe damage .
The maintenance man came and got out as much water as possible but with a wet vac but it then started to smell from water . The landlord was called he lives out of town and he called a professional service to come and get the water out. It took several days of machines pumping water out .
My friend Dolly was beside herself . She was so upset .The landlord was going on vacation She volunteered to get estimates for him on repairs .She took the time to call two contractors had them come out and had written estimates done for the landlord.
The people who took care of the water damage had cut holes in the ceilings in the laundry area and in the Living room area .They threw all the possessions back in the laundyroom .Now she could barely walk in to the laundry area .Everything that was hung neatly on the wall was now thrown on the floor in a pile . The floor was riped up . When she went to turn on the light it sparked and shut off .
It has been almost two months and nothing has been done . The landlord claims that his Insurance company denied the claim . Dolly told me no one from his insurance company ever came out. He says he hired an insurance adjuster but no one has contacted her .Every-time she calls the landlord he tells her she can break he lease if she does not like it .
Breaking the lease would prove a hardship on Dolly . She would have to pay for a mover . . Take the time to find a new place to live . Come up with the money that is required when you rent a new unit which is usually the equivalent of three months rent . I keep telling her to consult with a lawyer . She claims the landlord is a nice man but is very upset with the living conditions . In my opinion the landlord must provide safe living conditions . He is not .
His words to her are it could take up to a year for this case to get settled
It is the woman up stairs fault
So I am turning to my friends at Active Rain
