Today was the property management meeting at the Board. Mark Moore, attorney with the Texas Real Estate Commission spoke. He made a good presentation with numerous solid suggestions for Realtors to make sure they stayed out of trouble reference property management issues.

Attorney Moore recommended that brokers read and follow carefully Rule 535.146 on Maintaing Trust Money. He indicated money was one of the major issues of complaint to the commission.

He also indicated the Texas Real Estate Commission website would be changing and improving very soon.'

Under the new website  www.trec.texas.gov there would be a brand new-News and Public Data Tab, Frequently Asked Questions, Meeting Dates, Agenda and Minutes plus much more.

He noted from September 2015 to September 2016 that just over 10% of all complaints had to do with property management issues.

 

One of the areas from his talk that I found most interesting was reference complaint resolution results.

Under the Resolutions Results category the potential Options were -

1. No jurisdiction

2. No violation

3. Insuffient evidence

4. Advisory Letter (warning)

5. Formal Discipline (Agreed Order or Final Order (after a hearing or default.)

His biggest tip is if there is a complaint - cooperate fully.

All in all important information to remember.
