The title to the real estate, the important legal paperwork showing property ownership is stored inside the walls of the local registry of deeds.

Maine has sixteen counties but 17 registry of deed locations. Lots of types of real estate deeds. But like the Brooklyn Bridge, the existence of a deed is not worth the paper it is written or typed on if the title to it is not yours to convey. houlton maine snow winter photo

In our job as a real estate broker in Maine for 38 years, so many buyers and sellers figure if the deed to the property is a warranty one, all is good.

I would rather have a quitclaim deed with squeaky clean title than a warranty deed with a flawed title behind it.

Because you have to fix the flaws, or insure over them and a clean bill of health is always better than sickness to nurse back to health.

Billable hours and hunting down lost heirs in the chain of title where there is an outstanding interest. Claim to quiet title actions are expensive, slow, and do you ever read all that fine print in the Sunday paper in a lot of the search for needle in the haystack folks lost in the woodwork of life and history?

How far away is your registry of deeds in Maine or wherever the home, other property you own is on record?

And to have written, recorded proof you own the title to real estate if you lose the deed wrapped in legal blue and stored away in some nook or cranny where you can retrieve it someday when a sale is needed. Or your heirs inherit property in Maine to keep, rent, sell or trade. I am lucky to live in the Shiretown or County Seat for Aroostook County, in Houlton Maine.

So real estate closings are not delayed and the commission checks get cut, handed over the same day as the closing.

Maine is a big, vast under populated state which is part of her charm and mystique.

But the distance away the connecting the dots of the many small towns and handful of cities make travel part of living in Maine.

Interstate 95 helps speed up the movement, so does online Internet connectivity. I agree with you...a general warranty deed isn't that good if there are title issues.

Good title won't tap into the title insurance or force a lawyer to fix it for a big fee or funded from his E and O because he missed something.
