How To Choose The Right Realtor For Your Divorce.
If you and your spouse are looking in to getting a divorce and currently own a home, then you’ll need to know how to choose a realtor for your divorce. And, this applies whether one of you is going to keep the home or if you’ve agreed to sell it.
For most people, the marital property or home represents the substance of their assets and it is usually their single largest asset in total. And deciding on what to do with the marital home or homes has typically long and short term consequences for both parties involved. Considering all the potential impacts before deciding what to do, starts with finding the correct realtor to work with.
Most people would say this shouldn’t be too difficult – as most people have at least one friend who is a real estate agent, but using your friend may be just the first mistake you make. It is essential you find a realtor who is knowledgeable about the complications that can come with divorce.
An Agent Experienced in Divorce Real Estate is a MUST:
Your Agent Must Have Divorce Experience
Having a Realtor who is familiar with the divorce process in your jurisdiction, with an understanding of the deadlines and also events, such as a court appearance or a filing deadlines, that may be emotional triggers when calling you for a decision. Knowing and understanding timing is a important thing in keeping emotions at bay.
Having a Realtor that is comfortable with talking about divorce and understands that the marital home, is now part of a business transaction with many emotional ties that bind it. This agent will guide you through the tough conversations that need to happen rationally and without bias.
Your Agent Must Be Neutral In All Circumstances
When you were a married couple, you and your spouse worked together and your interests were aligned. Which is much different than working with a couple who is facing divorce. When working with a Realtor as a married couple, the Realtor is representing your interests as a couple, and divorce changes this dramatically. Even though you may still be legally married to one another, your interests may no longer be aligned with the other person. This is particularly true if the home is being kept by one of the parties, but can also be true when the home is being sold due to the divorce.
It is imperative that your Realtor needs to be a neutral third party. The Realtors position is to oversee the transaction completion, and to align and negotiate for both parties together for a favorable outcome for both parties respectfully.
Both Parties Have To Sign With The Agent
If you are selling your home due to a divorce, then both parties will sign the listing contract with the Realtor. You will need to agree on one Realtor to work on the behalf of both of you as the agent. Many times, this means one party making the decision on a Realtor, or both parties voluntarily coming to an agreement. But in some more combative situations, the parties’ attorneys negotiate this.
Communication Must Be Transparent at All Times During the Transaction
Open Communication is imperative around divorcing couples, and it is a neutral skill sets that can be challenging for an agent who is too close to the situation, or inexperienced. This is something that comes with experience and being comfortable around divorcing couples. To maintain the neutrality with the clients, sharing the same information is key for the Realtor. Much of the conversations are completed via email so both parties are privy to the same information. This is a standard practice in communication, whether it is via email or group text, everything is done in writing to both parties. This is much more time-consuming for the Realtor, but is a key element in making sure neutral communication is present.
Understanding How your Realtor Is Paid in the Transaction
If you will be selling your home due to the divorce, typically the Realtor will receive commission from the sale and will be paid from the sale proceeds at closing. That’s disclosed in the Texas Listing Agreement. If the house isn’t being sold due to the divorce, or you are still trying to decide if you will sell or not, you may need a Realtor on a home valuation. Some agents will charge a fee for this service, while others may provide it at no cost, looking to secure the listing if you decide to sell. Either way, finding an agent to make sure the neutrality is not compromised is essential.
You May Not Want to Hire Your Friend to Sell the House
With the amount of Realtors in the marketplace, we all have friends who are Realtors, and you may feel pressured to use them or the Realtor who sold you your home. Making this choice based on loyalty may not be a smart decision. Having your friend becoming familiar with your financial details of your divorce can be unnerving, or you might not want to work with them in this difficult and challenging time. Both parties will want to be assured of the Realtors neutrality and it is noted that your Realtor agent-friend is aligned with you or may be somewhat biased, then insisting on using them can make the selling process difficult and more volatile.
It comes down to this in a nutshell. You should choose the agent who you feel has the knowledge and expertise you need and who can and will work best with both parties. The agent should be able to work with both your styles of decision-making and emotion levels. Once you choose, be sure to bring the Realtor into the discussions early on, so you can use their expertise to help make your decisions easier, and to minimize unforeseen obstacles along the way.
