Who Is Responsible For Trimming The Hedges?

You would think this was a pretty easy question to answer, right? Usually, it is. However, I recently spoke to a tenant who did not realize it was their responsibility to trim the hedges of the rental property.

Generally, tenants are responsible for trimming hedges, mowing grass and cleaning the gutters of rental property in the beautiful state of Virginia where I am licensed as a real estate agent. If you are reading this, and you are not from Virginia, I advise you to find out what your local laws are regarding tenants and landlords.

If the property has elaborate landscaping on it, then the tenant would not be expected to maintain that, unless it was otherwise specified in the lease agreement. Or if a plant were to die, it would not be the tenant's responsibility to replace it. This doesn't give anyone license to go killing the plants in the yard.

That is great advice! I guess assuming someone who wouldn't read the lease, would read the list is reasonable?

Nanette, it is best to give the tenants a list of what they are responsibile for, and there won't be any gray areas.

A list may help in some cases. Certainly, can't hurt!

If there is a question of the responsibilities, it would be wise of the tenant to have it clarified in the lease before they move in.

I've clarified it verbally. I may have them sign or initial a list before moving in for my records. Not that it can assure that there is clarity, however, it may help.
